Background Facts You Need To Know:  The Clean-N-Shine (“Clean’) owners recognize the importance of effective recruitment and hiring.  They feel competent about recruiting and hiring new Clean management but want to hire an expert to recruit and hire employees to develop and manage their website, internal computer systems, and IT support.

They agree to hire a recognized expert in this area, George Tacy, to act as Clean’s agent in hiring website/computer/IT employees.  The owners want to give full authority to Tacy to direct every aspect of recruitment and hiring of these employees, from the initial recruitment of applicants to the final hiring process.

Clean owners want to ensure that their agreement with Tacy will be valid and include all important terms.  They have requested a meeting with TLG to discuss agency agreements.

Winnie and Ralph have asked you to join the meeting and respond to some of the Clean owners’ questions about agency law.

Instructions

Winnie and Ralph direct you to draft responses to several questions for the Clean owners’ meeting.

1.  Analyze and explain the rights of Clean under the agency agreement with Tacy.

2.  Analyze and explain two specific duties Tacy must perform under the agency agreement with Clean.

3.  Analyze and explain two potential liabilities Clean could face under the agency agreement with Tacy.

Repl

Discussion 1 reply 200 words: A teenage is a young adult between the age of 13–19 years old. At this age the teenager’s body is growing, going through a lot of changes, hormonal changes, and sometimes they may become anxious. Anxiety disorder is when someone worries excessively most often occurs daily for 6 months or more over common everyday interactions, work or their health (Mayo Clinic Staff, 2018). At this age the teenager needs a good support system, not just their family but their community. A community is group of people that lives in the same area/place, they care about each other and they feel that they belong together (Children’s Bureau, 2019). Teenagers may have the fear of not belonging and this may cause them anxiety but if they have peers in the community, it will give them a sense of belonging so it can lessen their anxiety. Benefits of a community for teenagers’ emotional support, builds confidence, practical support, conflict resolution and helps with preventing selfishness (Children’s Bureau, 2019). As a teenager they tend to lack confidence, self-esteem, a healthy community is a good place for the teen to get support by participating in activities with other teens and community leaders to be able to guide them to make good decisions, assist with conflicts by helping them resolve it properly. If the teenager is left alone and does not talk about their anxiety it can interfere with their growing emotionally, mentally and the anxiety can consume them. In health care we need to cognitive of how much anxiety is already present in teenagers, there is so much pressure out there and if they do not have a health family and community support available their anxiety can worsen. Nurses can work in the community by setting up support groups for teenager with anxiety to teach them coping skills, ways to manage their anxiety and also to assess if they need in-depth professional help, such as psychiatrist, psychologist, social worker, or therapist. If the teenage present needing this help, then the nurse can assist with facilitating them access to it. Education is very important in helping teenagers but it does not have to be formal, it can be informal and this will the help so it won’t intimidated them especially if they have anxiety already. Having activities in the community of helping others in need, or the elderly with yard work will promote teens to work with different ages and doing this physical activity will promote the teen to sleep better and this too will decrease anxiety. When the teenagers are in these support groups the nurse can assess them and how they are managing their anxiety and if they may require more help such as a social worker, psychiatrist or psychologist then the can assist the teenager with setting up further care.

Discussion 2 reply 200 words:  Mental illness in the community does not discriminate. It can impact women, men, young children, adolescents, the elderly, and any nationality.

  • Choose one population along with one mental health disorder and describe how the disorder impacts that population as they attempt to be part of the community.
  • Finally, explain one nursing intervention that would assist them to be successful.

For this discussion I choose to write about the elderly population. Choosing a mental health disorder for this specific population was difficult as there were several disorders that are common amongst the elderly. Although, I did decide to go with one that is ranked amongst one of the highest for elders-anxiety. Orrange states, that an estimated 10-20 % of adults over the age of 65 experience General Anxiety Disorder (GAD),  “ excessive, long-lasting worry about many things.” Per Dr. Orrange, anxiety disorder often goes hand and hand with another disorder to include panic disorder, obsessive-compulsive disorder, social anxiety disorder,  separation anxiety disorder, and other phobia-related disorders. (Orrange, S 2020).  With the overwhelming multitude of stressors that are placed on our elderly population daily, such as, loss of a loved ones, financial difficulties, fear of falling, fear of being left alone and unable to afford living expenses. All of these stressors begin to take a toll on their quality of life, and they begin to suffer.

A recent study of 75 elderly adults who had generalized anxiety disorder showed a worsening of their quality of life over individuals that had recently had an acute myocardial infarction or type II diabetes. Their anxiety disorder was compared to individuals with major depression disorder. Common occurrences seen in conjunction with the two disorders was their physical and mental anguish. Increased anxiety may lead to use of alcohol and substance abuse, which may hide or make symptoms worse. (Wetherell, J, et al, 2014).

As a nurse professional if you suspect an older adult may have anxiety problems, you should inquire and ask if there have been any changes in their daily routine. Do they appear worried all the time? Are they taking any medication, or have they had any recent changes in their prescriptions? Are they more tearful or withdrawn? As you are engaging in conversation with this resident try to remain calm, and reassuring. Acknowledge their fears but do not play into them. Encourage them to join some type of activity to preoccupy their mind. Offer them assistance with getting help from a physician or mental health specialist. There are pharmaceutical measures that a physician may take as well, although it will not a cure anxiety disorder but will aid in keeping them under control. (Sakauye, K. M., 2008).

Wk 3 6220 Discussion Response

The idea of neo-Psychoanalytic theory was the function of the unconscious mind (Cervone & Pervin,2019). This theory was proposed by Sigmund Freud who believed that our unconscious, subconscious, and conscious mind give way to a certain behavior (Cervone & Pervin, 2019). Emotions like fear, violence, immoral needs, selfishness lives in unconscious part of the brain and in certain situations come out as denial, dreams, speech by mistake and manners (Cervone & Pervin, 2019).

The idea of Behavioral Theory: Behavioral theory explains that the human behavior is a result of his experiences with the environment he lives in and his reaction to the external stimuli (Cervone & Pervin, 2019). Its emphasis is effect of behavior on mind (Cervone & Pervin ,2019). According to (Phelps, 2015) Behavioral theorists do not infer internal structures to account for behavior but look instead to the past or present environment to explain behavior. Behavior is studied only for what it reveals about non-observable, inferred constructs, said to be inside the person (Phelps,2015). The presence of any such non-observable structures is only inferred from behavior, never observed independent of behavior (Phelps,2015).

Difference between both theories

The psychoanalytic theory stresses upon significance of conscious, unconscious, and subconscious mind and how it results in the behavior while behavioral theory states that external stimuli affect the behavior of person which in turn affects human mind. So, behaviorists are least interested in studying the mental image of unconscious mind while neo psychoanalysis supports studying human mind.

Similarities Between these 2 theories

The similarly between the two theories is that both the theories study human behavior as their goal. One studying human thoughts while the other studying external stimuli, but the result is the same. i.e., human behavior. I feel, behavioral theory is more applicable as per my viewpoint since our actions and responses to the environment only decides our behavior.

Chapter 8

Review Question #4 on page 261 and then answer the following question:

The new age of technology presents many opportunities for litigation. The Internet is no exception. When operating Internet websites, an important part of it is owning the domain name (www.example.com). Anyone in the world can own any domain name that is available and the facts of this case arise from this concept.

The plaintiff, in this case, Weather Underground Corporation (Weather Underground), a Michigan corporation, is a commercial weather service. It owns and operates several domain names so that people can access their company through their websites. Defendants, in this case, Navigation Catalyst Systems, Incorporated (“NCS”), a Delaware corporation, owns many domain names that are similar to the plaintiff’s company name (some would result from people misspelling the correct domain name for Weather Underground). NCS profits from consumers going to one of these websites and clicking on links that are on them.

Plaintiff filed suit against NCS and several of its companies in the District Court for the Eastern District of Michigan. As defendants were not incorporated in Michigan, the issue of personal jurisdiction arise. The courts of appeals have held that in order to establish specific personal jurisdiction (showing that this company has established contacts with the forum state), one must show three things: (1) the defendant purposefully availed himself of the privilege of acting in the forum state, (2) the cause of action arises from the defendant’s activities there, and (3) the defendant’s acts were so substantial as to make the exercise of personal jurisdiction there reasonable.

The district court is considering whether the exercise of personal jurisdiction is proper. What should it decide and why?

Weather Underground Inc. v. Navigation Catalyst Sys. Inc., No. 09–10756, 2009 WL 3818191 (E.D. Mich. Nov. 13, 2009).

The district court is considering whether the exercise of personal jurisdiction is proper. What should it decide and why?

Week 5 Dicussion Forum Responses

RESPONSE ONLY! The 2 posts below are posts that need to be responded to. The response must be at least 100 words

POST 1

IFRS versus GAAP

Both accounting standards require a complete set of financial statements to include a balance sheet, a statement of stockholders’ equity, an income statement, and a statement of cash flows (Porter & Norton, 2018). While there are some similarities to both accounting standards, significant differences exist between the two. One such difference is the accounting of intangible assets. Intangible assets, such as goodwill, research and development, and advertising costs are only recognized if the asset will have a future economic benefit and has measured reliability under IFRS while all are recognized at fair value under GAAP.  Walmart has goodwill listed at 31,073 (in millions) on its balance sheet; under IFRS, Walmart would have to show a future economic benefit in order to be stated as an asset on its financials.

Other differences include inventory methods and reversals. GAAP prohibits reversals once inventory has been written down while IFRS allows reversals in future periods if specific criteria are met. GAAP allows for the use of LIFO whereas IFRS does not.

Pros and Cons

IFRS- is more of a principle-based system and not based on specific rules like GAAP. While this type of structure has its benefits and can be stated as an advantage, it can actually be a disadvantage as well. “Organizations can choose to use only the methods that they wish to incorporate in their reporting, allowing their financial statements to show the results they desire. This structure makes it easier to incorporate profit or revenue manipulation into the findings, making it easier to hide financial problems that might exist” (ConnectUs, 2019). GAAP-is rule based and therefore reduces the risk of misrepresentation. IFRS would provide simplicity for Walmart with less rules; however, converting to IFRS would be an extensive undertaking. With IFRS, Walmart would have flexibility in listing contingent liabilities. A significant disadvantage would be the the company would no longer be able to use the LIFO inventory method.

Czech Republic

As a member of the European Union, the Czech Republic uses the IFRS system and requires foreign entities to use unless the EU deems the foreign company’s standard to be equivalent (IFRS, n.d.). Companies are also required to keep accounting records in accordance with Czech GAAP for tax purposes or reconcile their IFRS financial statements to Czech GAAP (International Federation of Accountants, 2019).

POST 2

A major difference between GAAP and IFRS is the method used for reporting. GAAP is said to be rules-based and IFRS is principles-based. Since less detail is provided in international standards, there are usually more disclosures in notes using IFRS than there are using GAAP. GAAP has more standards and has a higher level of detail in standards.

Walmart values inventories at the lower of cost or market as determined primarily by the retail method of accounting, using the last-in, first-out (“LIFO”) method. LIFO is allowed by the GAAP standards but not by IFRS. If Walmart needed to change to IFRS they would have to change the way they value inventory and since Walmart carries a large amount of inventory which could lose them some of the tax advantages, it currently takes advantage of. However, if it were to make the switch to IFRS reporting, its international business/locations would all be uniformed in reporting which might make it easier in the long run. Convergence would also create transparency and comparability between different countries.

The fact that IFRS is viewed as being of being transparent could benefit Walmart when entering Peru.  From an ethical and legal perspective, switching over might have a rocky start since a lot has to be disclosed and it may be viewed negatively. However, by switching and being transparent, the company could create better business relationships with the country when entering the market.

Again there are 2 posts. Each post needs a response and should be at least 100 words.

Scope of Practice and Patient’s Healthcare Accessibility

Purpose

The purpose of this assignment is to identify the scope of practice in one’s state including level of independence of practice, prescribing authority, any limitations of practice, process for obtaining licensure in your state, certification and education requirements for licensure.  Next, students will discuss how the level of independence of practice in their state, i.e., reduced, restricted or full practice, affects patient’s access to care in their local community.

Activity Learning Outcomes

Through this discussion, the student will demonstrate the ability to:

  1. Understand NP practice as defined by law (CO2)
  2. Determine legislation as defined by legislation, statutes and regulations (CO2)
  3. Identify barriers to ensuring patient’s rights (CO3)

Requirements:

  1. Discuss your state NP community in terms of scope of practice. Include the your state’s scope of practice for NPs including:
    • Level of independence of practice **In California, NPs are required to practice under Standardized Procedure Guidelines. If CA is your intended practice state, please provide details on how Standardized Procedures Guidelines are developed in California and an example of a California SPG.
    • Prescribing authority
    • Any limitations of practice
    • Process for obtaining licensure in your state
    • Certification and education requirements for licensure.
  2. If you live in a restricted or reduced practice state, how has patient care been impacted in your local community from these barriers?  For instance, is the ED used for primary care?  Are the EDs overcrowded with long wait times?  Are there urgent care clinics readily available? Is there adequate access to primary care?  If you live in a full practice, how has independent practice of the APN resulted in improved patient access to healthcare?
  3. How does access to NPs impacts any healthcare disparities?
  4. A scholarly resource must be used for EACH discussion question each week.

DISCUSSION CONTENT

Scope of practice and NP requirements : Provides relevant evidence of scholarly inquiry of their state’s NP scope of practice. Uses valid, relevant, and reliable outside sources to contribute to the threaded discussion.

Practice barriers and access to healthcare: Provides relevant evidence of scholarly inquiry of whether their state is a reduced, restricted or full practice state and the impact on the local community with respect to healthcare access. Uses valid, relevant, and reliable outside sources to contribute to the threaded discussion.

Professional Communication Class – proposal assignment

Proposal assignment

Write a proposal that promotes ideas for improving the project management communication at your place of work. .

The audience for your proposal is your management. Your proposal can include charts, graphs, tables and photographs. The length should be 1,000 words +/- 10%. Longer is not necessarily better, but it should not be fewer than 900 words and no longer than 1100 words.

Include the following:

1      Detailed descriptions of project management communication strategies as they exist today.

2      Descriptions of project management communication strategies at other places of business (you can research true facts or invent hypothetical information here).

3      Three proposed new options for improved project management communication strategies, showing the advantages and disadvantages of each.

4      Your selection of the best option, which you will support with descriptive, factual evidence.

5      Make sure that your proposal contains all of the following headings, shown below in Components of a business proposal.

Components of a business proposal

A business proposal promotes an idea, suggests actions or asks a potential customer to buy a product or service. A proposal, similar to a report, generally contains a collection of objective data that the reader should consider. But the heart of a proposal, unlike the report, is the recommendation or sales pitch. The report can contain suggestions and recommendations, but its primary purpose should be to present facts and information. A business proposal spends most of its time promoting suggestions and recommendations. A business report spends most of its time presenting objective facts. Proposals propose. Reports report.

Please include all of the following headings and sections in your proposal:

Title Page

Business proposals generally follow a formal structure, unless they are very short email proposals. Most moderate to long proposals begin with a title page. The title page shows the full title of the proposal, the name of the author and the names of audience members or groups.

Abstract or Executive Summary

The proposal should also include an “abstract” or “executive summary.” This brief summary presents the purpose, methods, scope, findings, conclusions and recommendations of the proposal. A high-level business executive might choose not to read the entire proposal, but instead to read only the executive summary. Write the summary with enough detail to provide a busy executive with the most important elements of the proposal.

Table of Contents

The table of contents page usually comes immediately after the title page and before the executive summary. It should show each section of the proposal by name and page number.

List of Figures, Tables, Abbreviations or Symbols (optional)

A good rule of thumb is that if your proposal includes more than five figures, illustrations or tables, you should list them by page number, immediately after the table of contents page. If the proposal contains abbreviations or symbols that might not be familiar to all readers, include those abbreviations and symbols, plus their definitions and explanations in this section. Not all proposals need to contain this section.

Introduction

Start the body of the proposal with an introductory paragraph, with the heading “Introduction.” The introduction should present the purpose and scope of the proposal, and present background information that might be necessary for readers to know so that they can understand the rest of the proposal.

Body

The next heading should read “Body,” and this begins the heart of the proposal. You can include subheadings to introduce the various information categories that make up the body. Consider including tables of data or financial information, charts, graphs and illustrations.

Conclusions and Recommendations

The body of the proposal ends with “Conclusions and Recommendations.” In this section, you summarize the objective data and findings, and propose recommendations, if necessary and appropriate.

Bibliography

If your proposal presents data that you gathered from published sources, show those sources in a bibliography that should include traditional publications, Internet sources and people who you might have interviewed.

Health insurance literacy

Health insurance literacy is defined as the “degree to which individuals have the knowledge, ability, and confidence to find and evaluate information about health plans, select the best plan for their own (or their family’s) financial and health circumstances, and use the plan once enrolled.”1 Ask a friend or family member about their health insurance plan. Is it provided by their employer or did they purchase it in the health insurance marketplace? What is their co-pay? What is their deductible? What type of plan is it? How much do they pay per month for their plan? Does their plan cover dental, vision, prescriptions, etc.? If so, to what extent are these things covered? Overall, are they satisfied with their plan? Feel free to add any other questions that will help you assess the level of understanding people have of their health insurance plans.

Your post is a commentary on the awareness of people of the details of their plans and how to use them. I want you to comment on the individual’s health insurance literacy. Did they seem knowledgeable of the details of their plans, were they confused by their plans, were you surprised by what you noticed? Did you learn something new about health insurance plans after talking to this individual, etc.?

Please note that the post is not a question and answer format but a summary of your assessment of the individual’s health insurance literacy. Make sure that you don’t include any names or identifying information related to the individuals you interview. Write up your commentary in around 350-450 words.

Note: You can view the rubric for the Discussion Board in My Grades.

Complete a Depreciation Schedule for Furniture Resellers

In this exercise, you will create a depreciation schedule for Furniture Resellers as of 12/31/2016 using an Excel table. You will then sort, filter, and analyze the data in the table. These fixed assets, with associated data as of 12/31/2015, were acquired prior to the current year.

Date of

Acquisition 1/1/2007 1/1/2009

1/1/2013 Cost $8,200 $11,000 $4,000

Salvage Value

$700 $200

$0

Useful Life (years) 10

9 5

Accumulated Depreciation

$6,750 $8,400

$2,400

Furniture Resellers also acquired lobby furniture on 1/1/2016. The lobby furniture had a cost of $2,000, an estimated salvage value of $400, and an estimated useful life of eight years.

1. Open a Blank Workbook and save the file in your Chapter 06 folder as: EA6-A2-Depreciation-[YourName]

2. Enter appropriate bank reconciliation headers in the range A1:A2; apply italic formatting.

3. Enter the fixed-asset data in the range A4:F7; for the accumulated depreciation, enter the title but not the dollar amounts.

4. Format the range A4:F7 as a table using Blue, Table Style Dark 6 and add Depreciation _ Schedule as the table name.

5. Add a total row to the table that shows sums in columns C:D and an average in column E.

6. Turn on the First Column and Last Column table style options.

Adjust Table Rows and Columns 7. From within cell F7, extend the table to add one additional row and enter all fixed-asset information for the newly acquired asset.

8. Add two columns to the far right of the table with the headers Depreciation Expense and Year-End Book Value, in that order.

9. Wrap the text in the headers.

10. Apply appropriate column widths and, if necessary, autofit the header row height. 11. Change the orientation of the worksheet to Landscape.

Use Depreciation Functions

12. Use an Excel function to calculate depreciation expense for each fixed asset under the sum of the years’ digits method. Hint: Turn off calculated columns when entering the formulas for each fixed asset.

13. Replace the formula with one that uses an Excel function to calculate depreciation expense for each fixed asset under the straight-line depreciation method. Use calculated columns so you can enter the formula in a single row and have it automatically extend to all other fixed assets.

14. Use structured references to calculate the accumulated depreciation for each fixed asset.

15. Use structured references with calculated columns to calculate the year-end book value for each fixed asset.

16. Use the Sum function on columns F:H.

Sort and Filter a Table 17. Sort the data based on accumulated depreciation from smallest to largest. 18. Filter the table to not display fixed assets with a salvage value of $200.

19. Clear all filters; apply a new filter that displays only fixed assets with a useful life greater than six years.

Create a Chart Using Quick Analysis

20. Use Quick Analysis to create a bar chart displaying the year-end book value for each fixed asset presently displayed in the table. Position the chart below the table.

21. Apply the Accounting number format with zero decimal places to all dollar amounts.
