Business Law #8

The case study should be at least two pages in length and   include at least two outside sources. Be sure to use APA formatting for all   citations and references. Read carefully and answer fully.

Calvin had been an avid coin collector for many years, and   the most valuable coin in his collection was an uncirculated, mint condition,   1943 Lincoln penny made of copper (most pennies made during World War II were   made of zinc because copper was needed in the war effort). That penny had a   value of between $60,000 and $95,000.

In August of 2017, Calvin had a serious stroke that left   him unable to speak or walk, but his doctor assured his family that Calvin   would recover over time with intensive therapy.

Calvin was a widower and did not have any children, but he   had several nephews who visited him from time to time as he recovered. None   of the nephews had any real interest in Calvin’s coin collection. One of   Calvin’s nephews, Billy, who visited Calvin more often than the other   nephews, sometimes listened to Calvin talk (talking was a part of Calvin’s   therapy) about his mounting medical bills and his coin collection, but Billy   never showed much interest in the medical bills or the coin collection.

In October, as Calvin’s recovery progressed slowly, Billy   visited Calvin and told Calvin that he had been reading about coin   collecting, and he realized that Calvin’s collection, especially the 1943   Lincoln copper penny, was valuable, and Billy suggested that Calvin should   consider selling the 1943 Lincoln copper penny and use the proceeds to pay   his medical bills. Calvin resisted the idea at first, but Billy continued to   urge Calvin to sell the penny so that he would not have to worry about the   medical bills. Finally, when Billy told Calvin that he would arrange the sale   of the penny for a commission of just 5% of the sale price of the penny,   Calvin began to think that selling the coin might be a good idea. He was   still a little confused about how the sale would work and what Billy would do   to make sure that the penny would be sold for the best price. Calvin told   Billy that he thought that the penny was worth almost $100,000, but Billy   assured Calvin that the market had changed recently, and that the penny was   now worth $40,000 to $45,000. Eventually, Calvin allowed Billy to sell the   penny for the best price he could get and to take a 5% commission for   arranging the sale of the penny. Billy then sold the penny to a friend for   $40,000, took his 5% commission, and paid the remainder of the sale price to   Calvin.

A few months later, as Calvin continued to recover, he   read a story in a coin collecting magazine about how an uncirculated, mint   condition, 1943 Lincoln penny made of copper had just sold at auction for   more than $100,000, and Calvin began to wonder if Billy had taken advantage   of him. Calvin consulted a lawyer and asked the two questions below.

  • Did he (Calvin) have the mental capacity to enter        into the contract when he agreed to let Billy sell the penny? What would        he (Calvin) have to prove to show a court that he did not have the        necessary mental capacity when he authorized Billy to sell the penny?
  • Did Billy exert undue influence over Calvin to cause        Calvin to enter into the contract that allowed Billy to sell the penny?

What do you think? Does Calvin have a case to set aside   the contract with Billy on either of these theories?

Personal Theory & Reflection ESSAY

Activity Instructions:

“A feminist is anyone who recognizes the equality and full humanity of women and men.” ~ Gloria Steinem

Part 1:

Briefly summarize you personal theories of gender at the end of this semester by discussing how you viewed gender before this class and how your understandings have evolved.

  • How would you describe your understanding of the gender binary, gender performance, gender socialization, intersectionality, masculinities, and gender diversity etc.
  • Based on the materials this week, explain your definition of “everyday sexism” and how it connects to some of these concepts.
  • Please describe an example of something in real life (other than what is presented in the material) that you would consider falling under your definition of everyday sexism. Why do you think this example is important and something people should think about/be aware of?
  • How can we understand this example intersectionally? What is the potential impact on both individuals and society

In this section it is critical to cite specific examples from the readings, video, discussions, and/or assignments to support your arguments. This does not mean you need to agree with all of the authors, but you should be able to explain the ideas you are discussing. Do not limit yourself to the most recent readings. Reference any assignment or reading/video that stuck out to you throughout the semester.

Part 2:

Please discuss how you feel you performed in the class overall and how well you have learned and demonstrated understanding of gender in society. For this section, you are evaluating your learning and how you think you have improved since the beginning of the semester. I will be taking your honest reflection into grading as well as the evidence you provide.

  • Which specific topics or assignments do you believe highlight your best work and why?
  • Which topics or assignments do you think could have been better or you still need better understanding on and why?
  • What do you think is the most important topic/concept/idea you worked on this semester and why?

Conclusion:

End your paper by discussing ways you have applied ideas from class to real life. This can include:

  • Conversations you have had with friends or family
  • Occasions when you have observed concepts in movies, TV or music
  • Times when you have noticed concepts at home, school, or work (outside of our class)
  • Any other relevant example- you have all done great work with this all semester in your discussion and activities.

This essay should reflect your true experiences, beliefs, and feelings- not what you think I or anybody else might want to hear. The essay will not be graded based the content of your theory, it will be graded on the basis of whether you took it seriously and answered the questions and explained your ideas coherently, completely, and to the best of your ability.

Papers should be between 700 – 1000 words (3-4 pages doubles spaced) and written in essay format with a clear introduction, paragraphs separated by subject, and a conclusion. You should also be sure to fully explain your ideas and include a works cited page for all sources. (I prefer ASA citations but you may use any format).

WK Discussion

Discussion: Prescribing for Older Adults and Pregnant Women

After assessing and diagnosing a patient, PMHNPs must take into consideration special characteristics of the patient before determining an appropriate course of treatment. For pharmacological treatments that are not FDA-approved for a particular use or population, off-label use may be considered when the potential benefits could outweigh the risks.

In this Discussion, you will investigate a specific disorder and determine potential appropriate treatments for when it occurs in an older adult or pregnant woman.

To Prepare:
  • Choose one of the two following specific populations: either pregnant women or older adults. Then, select a specific disorder from the DSM-5 to use.
  • Use the Walden Library to research evidence-based treatments for your selected disorder in your selected population (either older adults or pregnant women). You will need to recommend one FDA-approved drug, one non-FDA-approved “off-label” drug, and one nonpharmacological intervention for treating the disorder in that population.
By Day 3 of Week 9
  • Recommend one FDA-approved drug, one off-label drug, and one nonpharmacological intervention for treating your chosen disorder in older adults or pregnant women.
  • Explain the risk assessment you would use to inform your treatment decision  making. What are the risks and benefits of the FDA-approved medicine? What are the risks and benefits of the off-label drug?
  • Explain whether clinical practice guidelines exist for this disorder, and if so, use them to justify your recommendations. If not, explain what information you would need to take into consideration.
  • Support your reasoning with at least three current, credible scholarly resources, one each on the FDA-approved drug, the off-label, and a nonpharmacological intervention for the disorder.
  • 2-3 pages and 5 References

ENG 1272 MEMO T

Submit “Memo Final Draft” from Module 2/Chapter 10 after incorporating peer feedback. Files must be in Word or PDF. Please give it a serious revision.

( I think you should elaborate on the opportunities for students. What are the opportunities for children to improve their reading skills? I think you should also add the times to the schedule. That way is someone was covering your class they would know exactly what is expected and keep the children on their normal routine.  )

ORIGINAL MEMO THAT NEEDS REVISED IS BELOW

MEMO

To: All staff members

       Right Steps Child Care Center

From: Tonya Bell

           Pre-K Lead Teacher

Date: December 6, 2020

Subject: Classroom guidelines and schedules

This memo is being distributed to inform all staff members the schedule and guidelines that will be in room five if, for any reason, I am absent. This class is ages 4-6 however, the majority of them are 4. This class relies on consistency and teamwork between students and teachers. I decided to inform the following:

  • Current lesson plans
  • Opportunities for the students
  • The classroom schedule

Current Lesson Plans

Currently, the class is focusing on learning all about themselves. This can include many different facts such as; birthdays, full names, parents’ names, ages, and where they live. As well as, the first three letters in the alphabet and what words start with these letters (Allow worksheets and books to be handy and helpful).

Opportunities for the students

The main goal for this class is to allow all the children to learn and grow before getting into kindergarten. There are many opportunities that can be found in this class. Developing social skills, gross motor and fine motor skills. There is also multiple opportunities for a child to improve reading and writing skills.

The Classroom Schedule

The classroom environment can make a huge impact on a child’s mood. Make sure it is warm and welcoming. Each center should always be available to all students throughout the day. The schedule consists of:

  • Breakfast
  • Circle time/ large group
  • Centers/ small groups
  • Outside time
  • Lunch
  • Nap
  • Small groups
  • Free choice/ pick up

When following the schedule include fun transitions such as a clean up song or timer to switch to the next activity.

Health Care Managaement

Question 1:

What is the process of health policy making in the United States?

What is the process of health policy making in the United States? What are the main features of health policy? Why do these features characterize US health policy? Imagine yourself in a role of a health care administrator/manager. What impact does the health policy making have on your day-to-day operations and planning? What, if anything, can you do to “stay ahead of the game”?

Think about the recent elections. Should we anticipate changes? What would those be?

Question 2:

How do or will critical issues in healthcare (such as access, costs, quality, etc.) impact your abilities and responsibilities as the healthcare administrator?

Describe the critical policy issues related to access to care, cost of care, and quality of care. Pick your future career within the healthcare field. How does each of the above mentioned critical issues impact your responsibilities as the healthcare administrator?

Question 3:

Do you think that having other countries manufacture our generic drugs is the answer to lower drug costs?

Everyone needs affordable medications and everyone needs employment. However, we need to figure out a way so that we can manufacture our own medications and make them affordable. It is difficult to insure the safety of these medication when they come from other countries. The FDA has to be right on top of them to make sure they are putting in exactly what they are saying is in there.

Question 4:

Do you think all Medicare prescriptions should be free?

Medicare patients who are mostly the elderly 65+ or individual’s that have extreme health concerns are often in need of many medications. Do you think these medications should be free?

Question 5:

Do you think it’s wise to have provider’s from other countries do telehealth?

At first, I didn’t see a reason why not. But then again, this put provider’s here in the United States out of work. We are already short on primary care providers and telehealth is a way that they are able to reach out to patients who don’t have easy access into the offices. This allows people who want to keep their own provider but maybe they are homebound or just live a long distance from the office.

Cultural Humility and Competence

In this writing assignment, you will conduct an interview of a person from a culture different than your own, giving careful consideration to the concept of cultural humility.

Step 1 Choose a person to interview from a culture different than your own.

Step 2  Use your book or additional resources to research the cultural group’s health practices.  Think of questions you want to ask. Select a model of culturally-competent nursing care to guide the development of your questions.

Step 3 Conduct the interview (approximately 15-20 minutes).  Be sure to gather information to address the areas in step 4.

Step 4  In a two-three page paper, addressed the following:

  1. Describe how you used the chosen model of culturally competent nursing care to develop interview questions
  2. Summarize the interview questions used and the answers received, and address the following:
    1. With what culture does the person identify?
    2. How does this person define/perceive health and illness and how is this affected by his or her culture?
    3. Describe the person’s health maintenance, protection, and restoration traditions and how these have been influenced by culture.
    4. How has language and/or culture impacted:
    5. Access to health care
    6. Communication with health care professionals.
  3. Analyze the concept of cultural humility, based on the information that you gathered in the Interview.

Assignment 1: Case Study Assignment: Assessment Tools and Diagnostic Tests in Adults and Children/NURS 6512: Advanced Health Assessment and Diagnostic Reasoning

When seeking to identify a patient’s health condition, advanced practice nurses can use a diverse selection of diagnostic tests and assessment tools; however, different factors affect the validity and reliability of the results produced by these tests or tools. Nurses must be aware of these factors in order to select the most appropriate test or tool and to accurately interpret the results.

Not only do these diagnostic tests affect adults, body measurements can provide a general picture of whether a child is receiving adequate nutrition or is at risk for health issues. These data, however, are just one aspect to be considered. Lifestyle, family history, and culture—among other factors—are also relevant. That said, gathering and communicating this information can be a delicate process.

For this Assignment, you will consider the validity and reliability of different assessment tools and diagnostic tests. You will explore issues such as sensitivity, specificity, and positive and negative predictive values. You will also consider examples of children with various weight issues. You will explore how you could effectively gather information and encourage parents and caregivers to be proactive about their children’s health and weight.

To Prepare

  • Review this week’s Learning Resources and consider factors that impact the validity and reliability of various assessment tools and diagnostic tests. You also will review examples of pediatric patients and their families as it relates to BMI.
  • By Day 1 of this week, you will be assigned to one of the following Assignment options by your Instructor: Adult Assessment Tools or Diagnostic Tests (option 1), or Child Health Case (Option 2). Note: Please see the “Course Announcements” section of the classroom for your assignments from your Instructor.
  • Search the Walden Library and credible sources for resources explaining the tool or test you were assigned. What is its purpose, how is it conducted, and what information does it gather?
  • Also, as you search the Walden library and credible sources, consider what the literature discusses regarding the validity, reliability, sensitivity, specificity, predictive values, ethical dilemmas, and controversies related to the test or tool.
  • If you are assigned Assignment Option 2 (Child), consider what health issues and risks may be relevant to the child in the health example.
    • Based on the risks you identified, consider what further information you would need to gain a full understanding of the child’s health. Think about how you could gather this information in a sensitive fashion.
    • Consider how you could encourage parents or caregivers to be proactive toward the child’s health.

The Assignment

Assignment Option 1    A – M

  • Prostate-specific antigen (PSA) test
  • Pap smear
  • Fecal occult blood test

Please provide a description of how the assessment tool or diagnostic test is used in healthcare.

  • What is its purpose?
  • How is it conducted?
  • What information does it gather?

Based on your research, evaluate the test or the tool’s validity and reliability, and explain any issues with sensitivity, reliability, and predictive values. Include references in appropriate APA formatting.

Assignment (3–4 pages, not including title and reference pages):

Assignment Option 1: Adult Assessment Tools or Diagnostic Tests:
Include the following:

  • A description of how the assessment tool or diagnostic test you were assigned is used in healthcare.
    • What is its purpose?
    • How is it conducted?
    • What information does it gather?
  • Based on your research, evaluate the test or the tool’s validity and reliability, and explain any issues with sensitivity, reliability, and predictive values. Include references in appropriate APA formatting.

Leading Health Promotion for Populations

Identify one evidence-based strategy for leading efforts to attain optimal health for populations, on a local, national, or global scale.

Dr. Bartelt and fellow classmates, one effective strategy for leading efforts in optimizing health for populations on all scales is to involve all stakeholders that are affected in the population (Meit & Knudson, 2020).  Efforts to include all stakeholders by healthcare leadership are more well received and attain more effective results.  Stakeholders who are often overlooked for population health efforts are rural citizens who have less than adequate access to healthcare resources and significant disparities to receive healthcare services (Meit & Knudson, 2020).  Inequities vary by geographic location and these inequities allow leaders to make informed decisions and design interventions that make rural areas healthier, which is the overall goal of population health (Meit & Knudson, 2020).  By incorporating the strengths of rural populations, we can fully capture this stakeholder to achieve more effective and meaningful population health outcomes.

Describe one evidence-based strategy for leading population healthcare reform efforts within and across healthcare systems.

Leading population healthcare reform is one the DNP leader is well suited for and is poised to make a significant impact that affects all realms of healthcare.  To influence healthcare reform, we must ensure that dynamic measures are utilized that prioritize diversity and cultural competence while delivering a strong value and sustainability (Warner et al., 2020).  Since the implementation of the affordable care act, more people have been extended insurance coverage, but coverages seem to be declining due to increasing healthcare costs, which creates unique challenges to overcome to impact population health (Buerhaus, 2020).  The task of implementing efforts to reduce healthcare disparity through early screening can impact population health over an extended period, reducing healthcare costs and associated increases that lead to overall improvements in health and wellness for the population (Warner et al., 2020).

Describe one program designed to improve the health of populations.  How will you help advance the outcomes of this program?

“Birth to Three” is an excellent program that is used by the West Virginia Department of Health and Human Resources to improve population health in infants, reducing disparities later in life.  The program is conducted statewide, and the target population is infants under the age of three who have a delay in their development or may be at risk for having a delay.  The program is conducted under the auspices of the Individuals with Disabilities Act (IDEA) and assures that family-centered community-based services are available to all children and families at no cost.  This program assures that any child born with a cognitive, physical, social/emotional, adaptive, or communication delay can receive specialty services as well as family support to reduce the long-term impacts of these delays, increasing their chances of a meaningful life.

I can help advance these outcomes in my current practice by routinely screening and diagnosing children in this age group that are at-risk for developmental delays and help reduce disparities for the families of these children to increase their chances of benefiting from this program.  My healthcare system offers additional benefits such as transportation vouchers to help reduce disparities like this and to assure there is no interruption in services.  I truly believe this is a beneficial program that can impact population health significantly and one that I can help advance outcomes for.
