Module Overview

Believe it or not, we enter into contracts almost every day.

Imagine you walk into a store, the store offers to sell you something, and you accept the offer. Or suppose you are trying to sell your car. You place a sign in the window of the car, and someone calls you to discuss buying the car. This person wants to know about the car—how it runs, whether it has ever been in an accident, etc.

Both of the examples above are of bilateral sales contracts—though not many people would think of them that way.

This module introduces you to contract law. In it you will explore the various types of contracts and, also, learn about performance, breach, discharge of contracts, and contract remedies. You will not only read about the formalities of a contract but also apply those concepts to various situations.

Generally speaking, a party doesn’t enter into litigation when the issue is black and white. When looking at a situation, the first question to ask is, has a contract been entered into? Remember, there has to be an offer, an acceptance of the offer, and consideration. Contracts can be bilateral or unilateral, and both have some nuances.

Additionally, there are certain formalities required to enforce contracts that come within the statute of frauds.

You ring the warning bell and announce on the PA that everyone must leave the pool and return to the dressing rooms or leave the pool area. A large man who has just started swimming ignores the warning. A lifeguard tells him that he must leave and he shouts that he will not. A crowd of swimmers have gathered on the deck to see what happens. The swimmer shouts that he paid his money and he is going to have his swim. Take charge. How do you handle this situation?

Overview

In developing your expertise in transnational
organized crime (TOC) you will be writing a series of research papers. All
together the writing contained in all these papers combined would be quite
significant project! You will find that in some modules, the research papers
mimic our readings with respect to subject matter and some modules, the
research papers do not mimic the reading. Again, the goal of these research
papers is to stretch the depth and breadth of your knowledge. You should feel
well prepared to teach a course in TOCs after completing this course. The
research papers and PowerPoints you create could serve as the basis for such
class. Additionally, you will find that this course and the course CJUS701
Comparative Criminal Justice Systems complement each other very well.

Instructions

·       
Each
research paper should be a minimum of 6 to 8 pages.

·       
The
vast difference in page count is because some countries and/or crime/topics are
quite easy to study and some countries and/or crime/topics have very limited
information.

·       
In
some instances, there will be a plethora of information and you must use
skilled writing to maintain proper page count. 

·       
Please
keep in mind that this is doctoral level analysis and writing – you are to take
the hard-earned road – the road less travelled – the scholarly road in forming
your paper.

The
paper must use current APA style, and the page count does not include the title
page, abstract, reference section, or any extra material.

Requirements

Develop an 8–12 slide PowerPoint presentation with speaker notes based upon assignments in Weeks 3, 6, and 8, and the following: 

Develop an executive-level PowerPoint presentation with 8–12 slides with speaker notes and appropriate graphics.

Create a SWOT analysis for the company to determine its major strengths, weaknesses, opportunities, and threats.

Based on the SWOT analysis, outline a strategy for the company to capitalize on its strengths and opportunities, and minimize its weaknesses and threats.

Clinical Field Experience A: Social Studies Observation

 

Allocate at least 4 hours in the field to support this field experience.

Part 1: Observation

Observing a classroom environment can provide much needed detail and understanding of students’ learning needs and continued progress.

Observe a K-8 classroom during a social studies lesson. During your observation of the lesson, complete the “Social Studies Observation” form.

Speak with your mentor teacher and, provided permission, use any remaining time to seek out opportunities to observe and/or assist your mentor teacher or another teacher and work with a small group of students on instruction in the classroom.

Part 2: Collaboration Summary

Following your observation, have a discussion with your mentor teacher about the social studies lesson. In 250-500 words summarize your observation and discussion with your mentor teacher, and describe how you will apply what you have learned to your future professional practice.

After the Fact

 This week you have the option of  reading a chapter from After the Fact called, Material Witness. This chapter deals with the changing situation with material goods in the first half of the 19th century (1800s).  

In this chapter the authors of the book want to address:  what are the challenges that historians’ face when working with physical objects when trying to reconstruct the past?

 

So first you need to read the Material Witness chapter, and then answer the following 3 questions:

  1. Besides the objects themselves, what are some of the sources of information that can be used to help us understand material culture?
  2. How did the changes to buildings, discussed at a number of points in the chapter, reflect social and cultural changes that the US was going through in the late 18th and early 19th centuries?
  3. How is the idea of a “consumer revolution” as described on page 13 (last page) reflected in the differences between the two major paintings Quilting Frolic (pg. 5) and the parlor engraving (pg.11)?

Each answer should be a few paragraphs long and fully answer all parts of the question.  Once you are done with your answers the file can be uploaded to me.

Here you will keep notes on the various research materials that you read while researching your final project. The second portion of this document is a chart that you can use to take notes on key theories related to the theories you encounter during the course. Your first entry in your table was related to Freud’s theory. This practice will allow you to receive meaningful feedback on your use of this tool to help you support your final project.

Prompt: For this assignment, complete rows of the annotated bibliography section of the table with research you encounter during the course. Use research you have identified related to the final project’s selected theory. Note how the research is related to your selected theory for the final project. How relevant is the research? The chief technology officer (CTO) has indicated that your organization has been requested by the National Security Council (NSC) to comment on the upcoming National Cybersecurity Strategy. The NSC has asked for specific recommendations as it relates to the next cybersecurity strategy, private/public partnerships, and comments on how specific technologies should be incorporated into the assessment.

The CTO has asked you to collaborate with your team to provide the organizational input.

You will be collaborating with your previously assigned team on this assignment. It is up to the team members to decide how they will plan, meet, discuss, and complete the five sections of the paper. Remember, if a member fails to complete his or her part of the work, the team is still responsible for all sections. You will also complete a peer review for yourself and for each member of the team. Peer feedback will be incorporated into each team member’s assignment grade.

As a group, use the Cybersecurity Strategy, Law, and Policy Team Assignment Resources to write your paper, which should cover the following topics:

Part 1: National Security Strategy and Cybersecurity

  • After reading the National Security Strategy (2017), comment on the following.
    • Should the United States create a separate cybersecurity strategy to be published alongside the National Security Strategy (NSS), or do you feel the NSS is sufficient? Why or why not?
    • Consider your answer in the context of the original National Strategy to Secure Cyberspace (2003). What is not adequately addressed in the National Security Strategy (2017) as it relates to cybersecurity?

Part 2: Public/Private Partnerships

  • After reading the Cybersecurity Act of 2015, address the private/public partnership with the DHS National Cybersecurity and Communications Integration Center (NCCIC), arguably the most important aspect of the act. The Cybersecurity Act of 2015 allows for private and public sharing of cybersecurity threat information.
    • What should the DHS NCCIC (public) share with private sector organizations? What type of threat information would enable private organizations to better secure their networks?
    • On the flip side, what should private organizations share with the NCCIC? As it is written, private organization sharing is completely voluntary. Should this be mandatory? If so, what are the implications to the customers’ private data?
    • The government is not allowed to collect data on citizens. How should the act be updated to make it better and more value-added for the public-private partnership in regards to cybersecurity?

Part 3: Private Sector Organizations

  • Review the General Data Protection Regulation (GDPR) of the European Commission (EU). It includes many provisions and arguably strengthens data protection for individuals within the EU. It even includes the right to be forgotten. The United States does not have a similar regulation. There have only been a few regulations implemented related to US citizens’ private data, which include medical and financial industries. Some argue implementing regulation such as GDPR in the United States would hinder innovation. They contend that the End User License Agreements (EULA) provide sufficient protections and allow the citizens to make the choice of what is and is not shared.
    • As a private sector organization, do you believe that an equivalent to GDPR should be implemented in the United States?
