Legal and Ethical Scenarios

Select two of the scenarios. Support your responses with appropriate cases, laws, and other relevant examples by using at least one scholarly source from the SUO Library in addition to your textbook for each scenario. Do not copy the scenario text into the paper. Label the beginning of each scenario with the number you selected (e.g., Scenario 1). Cite your sources in APA format on a separate page. Submit your document to the Submissions Area by the due date assigned.

Scenario 1 – Contracts

Greg, a consumer in Tennessee, sent a purchase order to Campbell Manufacturing, a U.S. company,  for a 4000 PSI gas pressure washer valued at $1275. Greg needed a new pressure washer for his part time business of washing houses. The order did not specify how disputes between the parties would be settled. Campbell returned a definite, unconditional acceptance that contained one additional term which stated that disputes must be submitted to arbitration. Greg received the acceptance; however, he never agreed or objected to the additional term.

Campbell orally contracted to sell 15 pressure washers to London Painting Company a large commercial painting company  in France.

  • Explain the status of the contract between Greg and Campbell.
  • If a contract was formed, did the additional term in the acceptance become part of the contract?
  • Is the contract between Campbell and London legally enforceable? (Additional research outside of the textbook may be necessary).

Scenario 2 – Management of Corporations

Parker and Phillips incorporated  P & P Resorts Inc., a closely held Texas corporation.  Parker was president and Phillips served as vice president and director for operations.  Parker owned 40% of the stock, while Phillips owned 60%.  Both men met with CTA, a group of travel agents from California to discuss  special deals for booking groups into the resorts.  After the first meeting, all contracts with CTA were made by Phillips, who learned that there was a good chance that CTA would award the contract to P&P Resorts.  Phillips incorporated Travel Brokers and was its sole owner.  Phillips used P& P Resort’s time to work on proposals for Travel Brokers and managed to keep negotiations with CTA a secret from Parker.  When Parker discovered Phillip’s actions, he filed suit against him for wrongfully taking a corporate opportunity from P &P Resorts. Phillips claimed that he did not take a corporate opportunity because Travel Brokers did not have the financial ability to undertake the contract with CTA.

  • Provide the arguments for Parker and Phillips.
  • Determine which party should win and provide support for your selection.
  • Explain any ethical principles applicable to this case.

Scenario 3 – Product Liability

Allan was not a licensed plumber, but often installed hot water heaters as part of his job as a handyman.  Allan installed a new hot water heater manufactured by Bradford Inc. for Karla, a single mother with two children. Warnings were provided in large bold letters on a metal plate on the water heater.  Similar warnings were provided in the manual Allan provided to Karla at the time of installation. The warning on the water heater read “CAUTION: HOT WATER CAN SCALD.” The heater itself contained a picture of hot water coming from a faucet with the words “DANGER” printed above it. In addition, the following statement was printed on the water heater.

Warning! Water temperature over 120°F can cause severe burns.  Children, elderly persons, and the disabled are at higher risk of being scalded. Test water temperature before bathing or showering.  Temperature limiting valves are available, see manual.

Allan set the temperature to 105°F. The next day, 3-year-old Simon was being bathed by his 12-year-old sister, Linda. When Linda received a text on her cell phone, she left Simon alone in the bathtub with the water running. Simon was scalded by the water from the tap. Simon’s mother brought suit against Allan and Bradford Inc. alleging defects in the design of the water heater and Allan’s failure to warn her about the heater’s dangers.

Films presents and express the idea and thoughts from director to audience. The directors need to ensure that the way they set up scenes, music and actors help capture the audience and correctly presents main topic. For example, the film Titanic is based on true events and shows that emotions of happiness and sadness. This film impacted society emotionally, we lost 1,496 people on that day on a ship that they said ensured wouldn’t sink.  In the film made the actors present and show the emotions when the ship is sinking and allows the audience to also feel those emotions.

All films have an impact to someone, wether it be good or bad, the film still has meaning. Directors are tasked with telling a story that reaches the audience in a way that effects them the most. When addressing ‘touchy’ subjects, films usually get strong reactions good and bad from society. “There have been films throughout history that have had great social impact because they went beyond the limits of what previously had been standard in the film industry. Many of these films that pushed the envelope also made a large impact on audiences.” Goodykoontz 2019. A good example of this is the film Boyz in the Hood, a raw depiction of inner-city life in the African-American community in Los Angeles. The film was directed by the late John Singleton, starring Cuba Gooding Jr. (Trey), Morris Chestnut (Ricky), and Ice Cube (Doughboy). “Drawing heavily on his own teenage years, Singleton introduced a largely oblivious world to the harsh urban realities of too many African American lives.” Smith 2019. This film shocked audiences and left them with so many questions wanting to know more of these realities. Still today many people (unfortunately) can still relate to many elements of this film, because of that it is still a very relevent film.

Films for Ethical Analysis Essay

John Q (2002) – Story centers on a man whose nine-year-old son desperately needs a life-saving transplant. When he discovers that his medical insurance will not cover surgery costs and alternative government aid is unavailable, John Q. Archibald takes a hospital emergency room hostage in a final attempt to save his child.

The Jacket (2005) – A Gulf war veteran is wrongly sent to a mental institution for insane criminals, where he becomes the object of a doctor’s experiments, and his life is completely affected by them. The film centers on a wounded Gulf war veteran who returns to his native Vermont suffering from bouts of amnesia.

The Last King of Scotland (2006) – While in Uganda on a medical mission, Scottish doctor Nicholas Garrigan becomes the personal physician and close confidante of dictator Idi Amin. Although at first Dr. Garrigan feels flattered by his new position of power, he soon realizes that Amin’s rule is soaked in blood, and complicit in the atrocities. Garrigan faces the fight of his life as he tries to escape Amin’s grasp.

My Sister’s Keeper (2009) – Told from multiple perspectives, My Sister’s Keeper follows the story of 13-year-old Anna Fitzgerald as she sues her parents, Brian, and Sara, for medical emancipation. Anna was conceived as an allogeneic donor for her sister, Kate, who has acute promyelocytic leukemia (APL).

Extraordinary Measures (2010) – John Crowley is a man on the corporate fast-track, with a beautiful wife and three children. Just as his career is taking off, he learns that his two youngest kids have a fatal disease. John leaves his job and devotes himself to saving their lives. He joins forces with Dr. Robert Stonehill, a brilliant but eccentric scientist. Together they battle the medical and corporate establishment, racing against time for a cure.

Contagion (2011) – When Beth Emhoff returns to Minnesota from a Hong Kong business trip, she attributes the malaise she feels to jet lag. However, two days later, Beth is dead, and doctors tell her shocked husband that they have no idea what killed her. Soon, many others start to exhibit the same symptoms, and a global pandemic explodes. Doctors try to contain the lethal microbe, but society begins to collapse as a blogger (Jude Law) fans the flames of paranoia.

Awakenings (1990) – The story of a doctor’s extraordinary work in the Sixties with a group of catatonic patients he finds languishing in a Bronx hospital. Speculating that their rigidity may be akin to an extreme form of Parkinsonism, he seeks permission from his skeptical superiors to treat them with L-dopa, a drug that was used to treat Parkinson’s disease at the time.

Coma (1978) – A young doctor in a hospital discovers that many patients are being induced into comas from simple routine surgeries. She soon finds a deep conspiracy developing that leads her to believe that nothing is as it seems. The comas are deliberate acts to permanently incapacitate patients who are later transferred to a facility called The Jefferson Institute where illegal activities are being conducted with comatose subjects.

Extreme Measures (1996) – A young British doctor confronts a famous colleague about the true methods of his work. The doctor wishes to determine why the body of a man who died in his emergency room disappears.

Gattaca (1997) – Vincent Freeman has always fantasized about traveling into outer space but is grounded by his status as a genetically inferior “in-valid.” He decides to fight his fate by purchasing Jerome Morrow’s genes, a laboratory-engineered “valid.” He assumes Jerome’s DNA identity and joins the Gattaca space program, where he falls in love with Irene. An investigation into the death of a Gattaca officer complicates Vincent’s plans.

Title Page – In APA format, include your paper’s title, your name, and your institution (i.e., Galen College), in that order.

Introduction – Provide a brief synopsis of the film that includes the ethical dilemma present in the film. Introduce the ethical theory you will use to analyze the film.  

Ethical Analysis – Apply one ethical theory to the medical ethical dilemma presented in the film. First, describe this ethical theory in your own words, using the readings and course materials as textual evidence for your explanation of the moral view. Next, discuss how this ethical theory could provide solutions or recommendations for remedying the ethical dilemma featured in the film. In your analysis, be sure to address the following questions:

  1. What moral values are present in the film (as they relate to the ethical theory you have chosen)?
  2. Are there instances of moral values in conflict with one another?
  3. What moral guidance does the ethical theory that you selected provide the characters in the film?

Decision making is the process of identifying and choosing alternative courses of action. While we want to make rational decisions, sometimes we don’t—sometimes we make non-rational decisions.

There are four steps in rational decision-making:

  1. Recognize and define the problem or opportunity. In business, the problem can come in the form of customer complaints, supplier breakdowns, staff turnover, sales decline, and so on. Organizations proactively seek opportunities to exceed goals, surpass the industry expectations, and to expand and grow the business.
  2. Identify and analyze alternative courses of action. Leaders should seek input from multiple sources to interpret and analyze the problem/opportunity to come up with as many options as possible to solve the issue.
  3. Choose a preferred course of action. The group want to answer the following:
    • Is the action ethical?
    • Is it feasible? (Costs, technology availability.)
    • Is it effective? If your answer to this question is the resolution is “good enough,” you want to rethink this solution—it will cause more harm than good.
  4. Implement the preferred course of action. You need to the participation from all teams to successfully implement the action.

On the other hand, non-rational decisions are generally the result of either satisficing (going with the first available option without much research) or intuition (using your “gut” or just your own feelings to make decisions).

For this week’s discussion, think about a time when you made a non-rational decision on the job or in your personal life.

Research Article Summaries

This assignment is the first step toward completing the literature review in Week 3.

· Choose a general topic that you are interested in. Use the Area of Interest interactive downloadto guide your efforts. Narrow the topic so that you are looking for research to answer a particular question.

For example:
“What is the experience of military families when their soldier is deployed?” or
“Is there a link between hours of television viewing and violent behavior in children aged 8-14?”
Think of a question that might be answered in a number of different ways. Briefly describe your topic and research question.

· Conduct a search through the Ashford University Library and locate a minimum of five (5) research studies from peer-reviewed sources that are related to the topic of your choice. Find at least two studies that use qualitative data and at least two studies that use quantitative data.

· Write a 350-word (double-spaced) synopsis/review of each article in your own words. Be sure to read the article fully to accomplish this goal. Do NOT simply rely on the Abstract, as the Abstract is limited in two ways: 1) it omits important information you might find useful; and, 2) it does not describe all aspects of the research that you will need for your literature review in Week 3. Thus, be sure to discuss what you find significant about the study for your topic, not just, what the author thought.

· The assignment should include:

1. A brief discussion of your topic and research question.

As you continue your reflective journal, this week you discuss your eating habits, weight-loss program readiness, and physical fitness. Each week you will submit your reflective journal for instructor feedback, make the corrections or updates and submit all the previous weeks’ journal entries.

Activity Instructions

Complete the sections, Assess Yourself on the following pages of the textbook:

  • How Mindful and Healthy Are Your Eating Habits?, on pp. 296-297.
  • Are You Ready to Start a Weight-Loss Program?, on pp. 320-322.
  • How Physically Fit Are You?, on pp. 359-360.

Follow the instructions below.

  1. Total your scores and analyze your results.
  2. Based on your results, reflect on your eating habits, weight-loss program readiness, and physical fitness and answer the following questions:
    • This week, spend some time in the produce section of the supermarket. Purchase your favorite fruits and vegetables, and try something new to expand your tastes. What did you try? Were you able to persuade a family member to try it? How can you incorporate new healthy foods into your diet? Describe some of your healthy or unhealthy eating patterns. How does your attitude towards food or food choices influence those around you?
    • In terms of weight loss, do you feel you need to lose weight? Why or why not? Reflecting on your food choices for the week, what could you do to reduce the two of your most unhealthy food eating habits?
    • In terms of your physical fitness, experiment with taking an activity break. Spend 5 to 10 minutes between household or work projects to do some type of activity, such as abdominal crunches, push-ups, or yoga pose. How did this work for you? If you are already physically active, try the same process with someone you know who lives a sedentary lifestyle and reflect on the opportunity of helping others to live a healthier lifestyle. 

Note: If you find yourself healthy and there is no need for you to start a weight-loss or physical activity program, use the lab assessments at the end of each chapter to help a family member or a friend to find out if they are ready to do so. Make sure you reflect on the experience of helping others to achieve a healthier lifestyle. Furthermore, if you do not have access to the equipment to perform a sit and reach test as you complete the How Physically Fit Are You lab, feel free to report your personal feelings regarding your flexibility.

  • Your paper should be 5-7 pages in length (not including title and reference pages) and must follow APA guidelines, use Times New Roman, 12-point font, double spacing, with one-inch margins.
