As the quality control manager, based on my research the acceptable amount would be plus or minus .5 ounces. Any candy above or below the plus or minus .5 of the 12 ounces would have to be removed from the distribution line. The quality control technique I would implement to ensure better accuracy and hitting the 12oz mark would be an automated system that fills the Food and Drug Administration regulations. Since it is important each package to be closely within range of the targeted 12 ounces. Rodriguez (2021) shares that accurate, quality weighing symptoms are an important part of the quality control process.

According to a study on quality control by The University of Georgia (2010), as far as packaging and weight it is important to follow the below during the packaging process:
-receive the ingredients from an approved supplier

-have set product formulas that take any guess work out of production on a large scale
-ensure product standards set by the FDA are followed

-create and follow manufacturer procedures daily

-have critical control points throughout the production process to act as check points, and then analyze the product

-ensure label specifications are being followed per requirements

In an article by Hill (2016), he explains it is important to have a checkweigher who is the quality control enforcer and ensure products are meeting all standards and are the correct weight. The FTC clearly states in the following quote what the product labeling requirements are, “The Fair Packaging and Labeling Act (FPLA or Act), enacted in 1967, directs the Federal Trade Commission and the Food and Drug Administration to issue regulations requiring that all “consumer commodities” be labeled to disclose net contents, identity of commodity, and name and place of business of the product’s manufacturer, packer, or distributor” (FTC, 2021).

Based on the above research, the below steps would be integrated.
1. Ensure all equipment is reading weight accurately and is reliable
2.. Purchase from an approved supplier

  1. Automate set ingredient weights to eliminate weighing errors
  2. Install a scale that each package must pass through before being labeled for distribution
  3. Have checkweighers stationed at each major change in the process, at the exit of the scale to check on all product for weight issues and to review the final product to check for label errors

Prior to any work beginning, all individuals involved in the process would be educated on the FTC and FDA regulations and know how to spot violations.

  Interprofessional collaboration is the collective involvement of various professional healthcare providers working with patients, families, caregivers, and communities to consider and communicate each other’s unique perspective in delivering the highest quality of care. (Moss et al, 2016) At work, I saw a physician did not wash his hands before and after seeing a patient who I was taking care of. The doctor was busy, and I was afraid to interrupt him. I knew I should have told him that washing hands is important to prevent the spread of infections between patients. However, I was not able to tell him about it because of the fear. Hesitancy to speak up is one of the factors that may contribute to communication errors and/or adverse events. (Okuyama et al, 2014)

           According to Okuyama et al (2014), effective communication and teamwork skills are crucial to improve patient safety for health care professionals. Health care professionals are expected to speak up about their concerns before a critical event reaches a patient to provide a chance to correct the plan or intervention. (Okuyama et al, 2014) In addition, establishing a culture that empowers staff to speak up when concerned about the quality or safety of patient care is important. The Michigan Health & Hospital Association (MHA) Keystone Center has implemented the Speak‐Up! Award program that acknowledges frontline health care staff for voicing their concerns and making care safer. (Novak, 2019) And this program presents evidence that fostering a psychologically safe culture of speaking up yields fiscal and humanistic returns, both of which are crucial to sustainable, meaningful progress in safety and quality. 1. Select a recent court case related to disparate impact and explain what the organization could have done differently to prevent discrimination.

           According to Phillips (2020), disparate impact occurs when an action hurts a protected group whether it was meant intentionally or unintentionally.  The Board of County Commissioners of Weld County, Colorado v. Exby-Stolley court case is a disability-based claim that involves the Americans with Disability Act (ADA).  Laurie Exby-Stolley who is the plaintiff is a health inspector for Weld County, Colorado.  Due to a previous on-the-job arm injury, the plaintiff was unable to effectively execute her job and requested to be moved to a new position that would accommodate her needs.  Her request was then denied by the county due to the biased impact and influence her accommodations would have on other employees.  The plaintiff chose to resign and sue the county under the Americans with Disability Act (ADA) of 1990 for failing to accommodate her injury.  Nevertheless, her efforts were unsuccessful and dismissed in court because the plaintiff chose to resign of her free will and was not terminated by the county.  The case was later reversed by the court of appeals on the ground that the plaintiff was not required to prove that the county did not take adverse actions towards her, but instead only needed to state the fact that the county failed to accommodate her needs.  As of June 8, 2021, the Board of County Commissioners of Weld County, Colorado approved the petition to revisit the case (Board of County Commissioners of Weld County, Colorado v. Exby-Stolley, 2021).

           Since Ms. Laurie Exby-Stolley got injured on the job, the county should have accommodated her needs accordingly as long as the accommodation did not cause major hardship to the county (Phillips, 2020).  The ADA guarantees equal opportunity for qualified individuals with disabilities or perceived as having disabilities.  Ms. Exby-Stolley meets the proper skills and experience needed to perform her job since she was already employed by the county.  The Equal Employment Opportunity Commission further enforces the ADA regulations based on the member’s qualifications and accommodations.  Upon the unavailability of a re-assignment, the county could have provided the plaintiff with a temporary administrative function that limits the use of her arm.  On another note, resigning was not the best move forward for Ms. Exby-Stolley because the county never planned on terminating her.

     Negligent hiring is when an employer is responsible an liable for ay type of harm that is inflicted on third parties when the employer had knowledge of or should of known of the employee’s possible risk that can possibly cause harm to an employee and if the risk would of been discovered during the investigation.  While federal courts and the courts of nearly every state recognize a cause of action for negligent hiring, they apply different standards for liability—notably, to the degree of foreseeability required—and offer little clarity on how to avoid it (Clark, 2019). 

     Employers must continue to educate their employees on properly apply best practices when involves laws, limitations, and how to prevent liabilities that will not help make the Employers sufficient when it involves Negligent hiring and how that they are being practiced in organizations.  Standards for employers must be carefully evaluated as well to ensure that the best practices are currently being effective and followed. The relevance of the crime to the job in question as a factor in deciding whether to hire a candidate with a criminal record appears in the EEOC guidelines, fair-chance and negligent hiring laws, and recommended best practices. Job relevance is also an element in establishing the reasonableness of an employer’s exercise of due diligence in a negligence claim (Clark, 2019).
