Benchmark – Risk Management Program Analysis – Part One

The purpose of this assignment is to analyze a health care risk management program.

Conduct research on approaches to risk management processes, policies, and concerns in your current or anticipated professional arena to find an example of a risk management plan. Look for a plan with sufficient content to be able to complete this assignment successfully. In a 1,000‐1,250-word paper, provide an analysis of the risk management plan that includes the following:

  1. Summary of the type of risk management plan you selected (new employee, specific audience, community‐focused, etc.) and your rationale for selecting that example. Describe the health care organization to which the plan applies and the role risk management plays in that setting.
  2. Description of the standard administrative steps and processes in a typical health care organization’s risk management program compared to the administrative steps and processes you identify in your selected example plan. (Note: For standard risk management policies and procedures, look up the MIPPA-approved accrediting body that regulates the risk management standards in your chosen health care sector, and consider federal, state, and local statutes as well.)
  3. Analysis of the key agencies and organizations that regulate the administration of safe health care in your area of concentration and an evaluation of the roles each one plays in the risk management oversight process.
  4. Evaluation of your selected risk management plan’s compliance with the standards of its corresponding MIPPA-approved accrediting body relevant to privacy, health care worker safety, and patient safety.
  5. Proposed recommendations or changes you would implement in your risk management program example to enhance, improve, or secure the aforementioned compliance standards.

In addition to your textbook, you are required to support your analysis with a minimum of three peer‐reviewed references.

Prepare this assignment according to the guidelines found in the APA Style Guide, located in the Student Success Center. An abstract is not required.

This assignment uses a rubric. Please review the rubric prior to beginning the assignment to become familiar with the expectations for successful completion.

Scenarios

Choose one of these professional scenarios.

Scenario 1

  • Saban is a top-performing industrial equipment salesperson for D2D. After three years of working with his best client, he receives a text message from Pat, his direct manager, assigning him to a completely different account.
  • Pat has received complaints that Saban “gets all the good clients” and “is not a team player.”
  • Saban responds to the message and asks for a meeting with Pat to discuss this change. Pat responds with another text message that reads “Decision final. Everyone needs to get a chance to work with the best accounts, so it is fair. Come by the office and pick up your new files.”
  • Moments later, Saban sends a text message to Karen, his regional manager and Pat’s boss. It simply reads “We need to talk.”

Scenario 2

  • Amber, Savannah, and Stephen work for Knowledge, Inc., a consulting firm. While on a conference call with Tim Rice Photography, an established client, the group discusses potential problems with a marketing campaign. Tim Rice, lead photographer and owner, insists the marketing is working and changes are not needed.
  • Amber reaches over to put Tim on mute but inadvertently pushes the wrong button. She immediately says to Savannah and Stephen that the marketing campaign is not working and that “Tim should stick to taking pretty pictures.” Tim responds, “You know I can hear you, right?”

Scenario 3

  • James shows up to work approximately five minutes late one morning, walking silently and quickly to punch in at the time clock near the front desk.
  • Sarah, the front desk manager, says, “Good morning, James,” but James ignores her, punches in, and heads into the shop to his desk. Sarah rolls her eyes, picks up the phone, and dials the on-duty manager to alert her that James just arrived and should be reaching his desk at any moment.

Scenario 4

  • Paul works for the website division of SuperMega retail company. He receives an email late Friday afternoon indicating that a new computer will launch at the end of next June and it will be in high demand with limited stock. The three-page message also indicates that customers will be able to preorder the item 30 days before launch, according to the production company. Paul is asked to create a landing page for consumers who are interested in learning more about the product.
  • By mistake, Paul sets up a page that allows customers to preorder product that afternoon, well in advance of the company authorized preorder period. Late Friday evening consumers begin to preorder the product.
  • Sharon, vice president of product sales at SuperMega, learns of the error Saturday morning and calls Paul to arrange a meeting first thing Monday morning. Sharon explains to Paul on the phone that the company intends to cancel all of the preorders, and Paul responds that the company should honor the preorders because the error was internal and not the fault of consumers. After a heated exchange, Paul hangs up on Sharon when she insists that the preorders will be canceled because of Paul’s error.

Final Project: Work Plan (Research Proposal)

(You’ve read the overall assignment, so once you’ve decided on what website or problem you would like to solve, you will write a research proposal memo to me, describing what you want to do for the final project. A memo proposal is a common internal document in workplace, from proposing a switch from T-Mobile to Google Fi for the sales teams, to proposing research funding for a division, or a merit raise for staff.)

MEMORANDUM

June 27, 2021

TO:                     All Students

FROM:             Professor Sohan

SUBJECT:       Research Proposal Assignment

The research proposal assignment is a two (2) page, single-spaced proposal (in professional memo format) of your research topic for the final researched report, in this case the heuristic evaluation for the CS majors, or the analytical report for other majors. In this assignment, you will try to persuade me that the website/issue you have chosen (and what you are proposing) is worth pursuing. Your Research Proposal and the Final Report are on the same topic. In the Research Proposal, you propose a topic, a focus, and a set of questions for your research. A quality research proposal memo (full professional mode, here, people) will include the following:

Introduction (this subheading doesn’t need to be included in your memo, because, as the first paragraph, obviously it is the introduction)

You provide clear, understandable background on the company website/corporation/group; include the purpose(s) and intended/interested audience(s) of this subject.

Statement of the Problem

You provide a more detailed description of the problem with the website/problem and why it needs to be studied; describe your initial analysis and what you identified as potential problems that need to be studied.  The problem in this case may be just to identify how the website can improve based on your future evaluation.

Proposed Solution

If you are conducting a heuristic evaluation, the proposed solution would include which three or four evaluators from Nielsen’s Ten Heuristics you will be using and why this plan of analysis is feasible. Why did you choose those evaluators? Don’t assume your reader is familiar with details of a heuristic evaluation. What testing procedures will you use? Will you have 5 friends test the site? Will you ask grandparents to try to order pizza? Why is this the best plan for your goals? If you are not a CS/IT major, you can submit a hypothesis, a hope, an suggested possible solution.

Scope

The scope explains what is going to be in “the line of sight” of your research lens, and what will NOT be observed in your sight. For example, when deciding whether to move into the “school lunch business,” Papa John’s pizza researchers might indicate that their research ONLY includes PEPPERONI or CHEESE pizza consumption by children ages 5-13, because they have already determined children do not eat sausage pizza, or they have already determined that sausage pizza is too expensive to deliver to schools.

The scope also demonstrates to your audience that you are an experienced researcher who has some sense of the job before you begin. (In real-world applications, this section is crucial, as it gives the audience a detailed sense of your approach to the research. It also details what will NOT be included in this research and report.)

Methods

Include a preliminary, BUT SPECIFIC, list of your modes of inquiry. Are you going to have others test your website so you can gather some data? For secondary research, a partial listing of publications (books, journal articles, studies) you will review is sufficient. The list should include the names of the articles/books and authors. This section must be specific to some degree as it shows me that you have conducted some research and you have a plan for accomplishing your goals.

Audience

Who will your audiences for your finished product be? (It isn’t me!) Primary, secondary, etc.

Qualifications

What skills do you bring to this project? In the work world, proposals are met with skepticism. If you haven’t persuaded your audience on the problem and your actions, this section is crucial to proving you are the best person for this project. Tell me why you are qualified to do this research. Reflect who you are, your major, and why you are interested in this project.

Conclusion

The conclusion is the final request, ending with a call to action, encouraging me, your professor and reader of this proposal, to give you my approval for this research.

*Use the headings listed above and fill in the information based on your research.

Preliminary Research

Before writing your proposal, you need some direction in your research in the form of scope questions and primary and secondary sources. After you develop scope questions, start thinking about the sources you’ll use for your inquiry. Planning ahead like this will prevent unfocused floundering, which leads to procrastination, which leads to last minute work, which leads to bad semester projects.

As you write and review your proposal, please keep in mind the proper tone for a formal report, and remember Lanham’s paramedic method of “cutting the fat.”

Evaluation Criteria

I will be asking these questions:

  • Is the website/research idea interesting and in need of evaluation?
  • Has enough preliminary research been conducted to ensure strong data is available?
  • If available, is a proposed solution (or hypothesis) being offered?
  • Are the research methods and limits to the project announced?
  • Are solid qualifications offered?
  • Is a conclusion with call to action included?
  • Is the proposal professionally written and grammatically correct?

Entity Tax Research Problem

Problem 1: The taxpayer, a calendar year corporation, wants to change its company’s headquarters, which is currently a 10-story building. The company owns the property without a mortgage.

The company decides to exchange its existing property for a retail and residential building complex. You assisted the company is structuring the exchange. Both parties used the “middleman” corporation, to whom the properties were initially conveyed. The agreement with the middleman included the requirement that the taxpayer sell its property to the middleman, and then, within 45 days of the initial closing, formally identify which of the two new properties it intended to acquire. The identified property was also sold to the middleman corporation. The corporation would then transfer title to the taxpayer within 180 days after the date of initial closing.

Unfortunately, the transaction has not proceeded as planned. The taxpayer transferred its property to the middleman, receiving $10,000,000 in cash. The company formally identified the property it intended to acquire. Unfortunately, one week before the 180 days was up, the seller of the property backed out of the arrangement.

Taxpayer’s basis in the ten-story building is $2,000,000.

A) Will the company have to report an $8,000,000 gain since they can no longer get a “like-kind” exchange?

Problem 2: Terry owns real estate with an adjusted basis of $600,000 and a fair market value of $1.1 million. The amount of the mortgage on the property is $2.5 million. Because of substantial losses, Terry deeds/transfers the property back to the mortgage holder.

a) How much of a gain or loss does Terry recognize?

b) Suppose Terry is in bankruptcy, is your answer the same?

c) Suppose this is Terry’s personal residence for the last 7 years, is your answer the same as in a)?

Beginning by describe how this situation “swept” through the US around 2007 to 2010 (with appropriate citations) as part of the facts.

Directions: Each research problem should be answered in about 3 pages.

Please use the format of facts (4-6 lines), issues (question answerable as yes or no) and conclusion (yes or no) and analysis.

The analysis portion should be quotations from the source documents on RIA Checkpoint.  It should be Tax Code, US Treasury Regulations, Revenue Rulings, Tax Cases.  It should NOT be IRS publications from Google search, or page number references from the Pearson tax book.  Also, your quotes should be short and on point.  Your explanation – tying the quotation to the case at hand, should be at least as long, if not longer, than the quotation.

Also – look up “IRS Circular 230” on Google.  In the paper, tell what Circular 230 is and then discuss two ways that a tax researcher/preparer could violate Circular 230 – with quotations from Circular 230 and application – in your own words- to the case.  This should be in both the paper and the slide presentation.  The citations should be from in Subpart B in Circular 230.

Course Project Milestone: Annotated Bibliography

Instructions
First, return to your topic chosen in the week three assignment.

  • Answer this question: What are the personal and/or communal ethical factors that may be involved in determining the moral position of either side in that debate?
  • Next, articulate and then evaluate the ethical positions using Kantian ethics (that is, the categorical imperative) relative to the long-standing debate (that is your topic chosen in the week three assignment).
  • Finally, create a complete annotated bibliography for 5 academic scholarly sources. You will annotate each source. The sources should be relevant to your topic chosen in the week three assignment.

Include the following:

  • Publication details
  • Annotation (a detailed reading of the source)

Each annotation section should include the following:

  • Summarize key points and identify key terms (using quotation marks, and citing a page in parentheses).
  • Describe the controversies or “problems” raised by the articles.
  • State whether you agree or disagree and give reasons.
  • Locate one or two quotations to be used in the final research project.
  • Evaluate the ways in which this article is important and has helped you focus your understanding.

Use the following as a model:

APA Reference
Mezirow, J. (2003). Transformative learning as discourse. Journal of Transformative Education, 1(1), 58-63.

Annotation Example
In this article, Mezirow (2003) makes a distinction between “instrumental” and “communicative” learning. “Instrumental learning” refers to those processes which measure and gauge learning, such as tests, grades, comments, quizzes, attendance records, and the like. “Communicative learning,” on the other hand, refers to understanding created over time between individuals in what Mezirow calls “critical-dialectical-discourse,” (p. 59) which is a fancy way of saying, an important conversation between 2 or more speakers. Another key idea Mezirow discusses is “transformative learning,” (p. 61) which changes the mind, heart, values, and beliefs of people so that they may act better in the world. Mezirow argues that “hungry, desperate, homeless, sick, destitute, and intimidated people obviously cannot participate fully and freely in discourse” (p. 59). On the one hand, he is right: there are some people who cannot fully engage because their crisis is so long and deep, they are prevented. But, I don’t think Mezirow should make the blanket assumption that everyone in unfortunate circumstances is incapable of entering the discourse meaningfully. One thing is certain: if we gave as much attention to the non-instrumental forms of intelligence–like goodness, compassion, forgiveness, wonder, self-motivation, creativity, humor, love, and other non-measured forms of intelligence in our school curriculums, we’d see better people, actors in the world, and interested investigators than we currently have graduated high school.

“The closet” means gay, bisexual, transgender people who hide their identity. They did not disclose their sexual orientation or gender identity and various aspects, including sexual identity and sexual behavior. The reason may be due to social pressure, social circles, living habits, etc. In the United States in the 1920s, discrimination and hatred against homosexuals and bisexuals triggered their counterattacks. Special groups such as homosexuals began corresponding protests and marches. They sought equal rights and non-hateful treatment. They hoped that society would no longer insult hatred. Their particularity. As a special term, closet heralds a duality, that is, the opposition between homosexuality and heterosexuality. In the development process of homosexuals’ identity recognition, they are often confused and hesitant because they are contrary to common sense in society, but gradually, with their efforts, this kind of sexual orientation and identity have become more transparent and common. At the same time, the use of the term cabinet is more to help the gay community better understand the relationship between their identity and society and to ease the misunderstanding and maliciousness of the society.

“PHYSIQUE PIONEERS: THE POLITICS OF 1960S GAY CONSUMER CULTURE” by David K. Johnson, the author states that American consumerism helps homosexuals better integrate into society, “American consumer culture—despite many limitations based on income, gender, and race— opened up a space for a sexual minority group to define itself”(Johnson 2). The closet was originally a self-protection mechanism due to social pressure, that is, homosexuals question and confuse their own identity, sometimes because they are difficult to understand Or accept their own sexual behavior and stay in the closet. Gradually, society begins to accept and understand homosexuality and other sexual orientations. The closet is more inclined to explain homosexuality and other interpretations of one’s identity, which is more like an introduction to oneself. At the same time, consumer culture helps special groups to be better accepted by society. People take the initiative to understand these special groups because of consumer culture, and at the same time think about different sexual orientations through consumer culture, so they can accept different ideas faster.
Emotion has always been a very important factor in society, and the liberation of homosexual, bisexual, transgender, and other groups is also the liberation of the binary opposition of emotions. Love is never black and white, it is gray and fuzzy.  People can’t even describe clearly how they feel about others. This is the liberation of homosexuality. But such liberation is not a victory, but a rethinking of where these groups should exist in society. That is how to contact and communicate with the general group and live in harmony.
