Read “You Manage It! 2” in Managing Human Resources (2016, p. 177). After reading the case, complete the following items:

A key learning is defined as significant knowledge gained from reading the case. You may choose to explain your key learnings by offering a real-world application, personal insight, your thoughts and opinions about what was stated, how it is handled at your company, etc.

Assignment Choice #2: Staffing Case Study

Begin by reading the Staffing Case Study.

After reading the case study, evaluate the design and implementation of the recruiting and selection process (the case will describe a number of ineffective practices, a mismatch between job description and selection assessments, issues around adverse impact, and actions taken that are not in line with applicable federal laws).  Based on your evaluation, make recommendations to improve the design and implementation (applying learned materials regarding effective practices). 

Evaluation criteria will include: 

  1. appropriateness of recruitment sources
  2. links between job description and selection assessments
  3. identification of adverse impact
  4. compliance with applicable laws

  • Explain the ethical issues faced by the organization, summarize the legal and regulatory issues faced by the organization, and then summarize the organization’s corporate social responsibility.
  • Show, in this section, the possible implications of the triple bottom line (people, planet, profit) on the strategic plan and its implementation.

Prepare a minimum 350-word executive summary defining the new division of existing business. Share your Vision, Mission, final business model, and value proposition, and list your key assumptions, risks, and change management issues. 1.  Nineteen-year-old Lee J. Norris was employed by Burger Chef Systems as an assistant manager of one of its restaurants. On a day when he was in charge and change was needed, Mr. Norris left to get change but also decided to get Kentucky Fried Chicken at a nearby store for his lunch to take back to Burger Chef. The bank where Mr. Norris usually got change is 1.6 miles from Burger Chef, and the Kentucky Fried Chicken outlet is 2.5 miles from Burger Chef. After Mr. Norris left the bank and was on his way to the Kentucky Fried Chicken restaurant, he negligently injured Lee J. Govro in an accident. 

Is Burger Chef liable for the accident?

2.   Bernice Bisbee is a real estate broker employed by Midkiff Realty, Inc. In September 1972, she obtained from Richard and Marian Silva an exclusive listing agreement for the sale of their property in Kaleheo, Kauai. The land, which fronted on the Kaumualii Highway, consisted of 34,392 square feet, one two-bedroom house, and one four-bedroom house. The Silvas told Ms. Bisbee that they wanted $100,000 for the property. Sometime later, Ms. Bisbee obtained an offer for the property from David Larsen. The down payment was set at $35,000, with payments of $2,000 a month at 8% a year, but Mr. Larsen backed out before closing. After that, a joint venture of six members formed the Pacific Equity Associates to buy the property. Ms. Bisbee was to manage the joint venture and would receive 10% of the profits for her services. One of the joint venture members, Toshio Morikawa, appeared as the buyer at the July 1973 closing of the property sale. Ms. Bisbee did not tell the Silvas of the venture nor of her pecuniary interest in it. In August 1973, Ms. Bisbee prepared for the venture a financial statement that listed the market value of the Silva property at $149,424. Several times, the venture was late making payments, which Ms. Bisbee covered. Mr. Silva and his wife were emotionally distressed about the late payments and told Ms. Bisbee. Eventually, because of defaults on the payments, the Silvas brought suit to cancel the contract and for damages for fraud by Ms. Bisbee, naming Midkiff Realty in the suit as well. The jury returned a verdict for $29,000 in general damages for the Silvas and $50,000 in punitive damages. Ms. Bisbee and Midkiff appealed.

Was there a breach of fiduciary duty? Should the damage award stand because of Ms. Bisbee’s actions?

3.   Heritage Hills (a land development firm) was organized on July 2, 1975, as a limited partnership, but the partnership agreement was never properly filed. Heritage Hills went bankrupt, and the bankruptcy trustee has sought to recover the debts owed by the partnership from the limited partners.

4.  The Orleans Parish School Board hired Johnson & Higgins (J & H) to provide consulting services. J & H provided those services over the next few years but was then acquired by Marsh & McLennan, a larger insurance firm. Marsh continued the work that J & H had been doing and submitted an invoice to the Orleans Parish School Board for reimbursement. The Board said that it had no contractual arrangement with Marsh and, as such, was not liable for the services. 

Is the Board correct? Describe what happened in the relationships and apply the principles of corporate law to determine whether Marsh can be paid.

Discussion Post #1 – Week 1 Discussion Board Group 3

This week we covered ethical theory; different ideas about what makes an action right or wrong. All the theories have strong validity but also some weakness; in some ways they compliment each other and in some ways they conflict with each others.

Regarding this week’s Case for Discussion Board – the Case of Banana Terrorism you are to analyze the company’s actions through all of the different lenses.  Your response should answer the following prompts:

  • How did Chiquita’s actions align with and deviate from virtue ethics (character-based)? utilitarianism (consequence-based)? deontology (duty-based)? 
    • Explain, briefly, the case for each theory in a sentence or two, i.e. Chiquita aligned with virtue ethics because… and failed to meet standards in virtue ethics because…
    • Consider the three-part lecture on the three streams of ethics.
    • Discuss where Chiquita could have improved their decision-making process in light of any of the ethical lens in terms of the following 5 Steps to Making an Ethical Decision in the Business Environment:

Our weekly discussion boards are considered an academic forum.  In general, it is preferred to use APA format in all posts and submissions for this course.  If a need for further style boundaries emerges, we will address needs at that time.

1. My view point and purpose of doing philosophy is get see understanding  from more than one perspective. It like learning new way and using what  you have learn to get a better view. Example would be two words that  means the same thing but one is just more than the other one like light  and illuminate both means light. However illuminate seems to be worth  more. In the Value of Philosophy I like the point where we must free our  mind from the prejudices of what wrongly called “practical man” pg. 1.   What I receive is do not believe only on what you see and hear. Decide  for yourself what is wrong. Stand for yourself; do not just roll with  the normal because the million dollar question is it wrong; or are you  just close minded. In “The Apology of Socrates” …. they do not know  and cannnot tell pg. 3. He saying why down play who he is to please  people that are not willing to learn. They are willing to set fear in  others but will not bend to see or compromise understanding an  individual. Be able to be different; do not down play who you are  because the people are not willing to change maybe you can change they  way they think, or be history that made an impact.  

 

2. After reading the text, I’ve come to a conclusion that the purpose of  philosophy is education and is meant to be studied not for seeking  philosophic answers since no definite answers can be deemed true but  rather for these questions to allow us to see what possibilities could  come to mind. Everyone’s a philosopher because we all experience new  things and that’s when philosophy begins. Our mind begin to go up in  gears and start thinking of what endless possibilities there are and the  endless consequences there could be if one’s action is taken into  account. It is the pursuit of knowledge that makes us hungry for more  and each additional experience contributes to our conceptions. The  feedback of all of those experiences is philosophy and the way the truth  is perceived by us. It comes to a full circle around in a loop where  experiences first happen, then our conceptions, and lastly the feedback.  Then the loop all begins again but this time it will be added to our  conceptions from previous experiences. As more knowledge of philosophy  is gained, our wisdom will increase. Since possibilities are endless  with our experiences, then the capacity of wisdom will be infinite.
