Hello everyone,

As the leader of this week’s discussion, I am sharing with you guys the article I choose and showing the reasons why I think that this article could contribute to our understanding of this week’s materials. Chapter 8 of our book is about the international Legal Environment of Business that I found to be very interesting, and that is the reason why I choose to write about that specific topic.

The article is about the international legal environment, judicial Independence and Efficiency, Legal Systems, Principles of International Law, and The United Nations Commission on International Trade Law. The article gives us an idea about how the International Legal Environment can be complex and can vary from one country to another. “Firms operating internationally face major challenges in conforming to different laws, regulations, and legal systems in different countries” (Sarkar, 2016a). As we know from a country to another the law may change based on different factors. We understand then that is crucial to know about everything concerning the law of the country we are intending to do business with to avoid any type of conflict that can be related to the law applicable in that country. 

In the article, they advising to any international managers to collect all the information possible concerning how the law works in any specific country they are considering doing business with because “The level of judicial independence and efficiency differs widely among countries” (Sarkar, 2016a). For example, in China, they follow “rule by man and not by law” the tradition of which remains despite the country developing a model legal system (Sarkar, 2016a). That will be very important information to have before entering legal contracts with China. Another example I found interesting was Japan where the reliance on courts for conflict resolution is much lower compared to the US which is one of the most litigious societies in the world. On the other hand, “Japan is a ‘non-contractual’ society where contracts signed represent general understanding and are subject to change depending upon the circumstance” (Sarkar, 2016a). The article gives us the different types of legal systems we can encounter which are: Common Law, Civil law, Socialistic Law, and Theocratic Law. As mentioned in the article International law can be more complex than domestic law since it exemplifies a lot of different treaties. Here are the different types of legal systems I learn about while reading the article (principle of Sovereignty, Internal Jurisdiction, Doctrine of Comity, Treatment and Rights of Aliens, and Forum for Hearing and Settling Disputes. Here was some information about the article and some point I found interesting. I hope that you guys will enjoy learning about The Legal Environment and International Business as much as I did.

 Arts and Culture of a Country or a Work in the Humanities Presentation. If you have to talk about a country, the purpose is to help introduce nothing else than the art and culture of that country in a way that is creatively stimulating and enlightening.

 At the end of your presentation, we should have knowledge of the arts and culture of the country to the point you would want to visit that place. 

Please, nothing about flags, population, or natural resources like beaches and parks (your grade would decrease if you focus on that) focus only on the humanities of that country.

 If your presentation is about an important contributor to the Humanities, or about literature, work of art, discovery, artist, philosopher, inventor, etc. or about his/her works do it in a way a way that is creatively stimulating and enlightening, in order to increase our knowledge of the humanities. 

For example, if you are writing about a painter, how does the style or subject matter of his paintings tie in with the culture, philosophies or ideas of his time? From what time in history is this person? What promote his style? Mention prices won, his/her biography, most important works, etc. Add as many pictures as possible of his works of art.

 Never forget to specify their masterpieces and where are they located. This presentation must be done in Power point with many details as possible so we all can learn with pictures, videos and correct writing. The last page must be the works cited.

 All presentations must be uploaded in blackboard no later than the week before the last week of the semester. You would fine what presentation you must do on the presentation list tab on Blackboard. Presentations are to be taken seriously. Although they are short, they still require an intense dealing with the course material. 

These will be graded on the amount of specific details they contain. I am excited to hear your own thoughts and reactions to the work, not just those of others. Please do not take the decision of not doing your presentation for any reason; you would hate to lose these points.

 The maximum final grade you can get would be an 80 if you take the decision of not doing it. Presentations must be uploaded in blackboard. Here are some helpful tips for your presentations that you may want to read through every time you work on one: • Use many details from the person, the country or the theme you have to present about. Ask questions to the public to make them active participants.

 For example, if you are presenting Rubens, talk about his art, his style, what influenced his style, how much influence the era and culture has on his work. Show pictures of his most important works of art, quote lots of specific lines from your sources (followed by citations) to prove your argument. The more specifics you give me, the better the grade you will receive.

 • If you are presenting France, talk about the origins of the country and their culture, their art, artists, philosophers, writers, scientists, inventors. Find about their way of living, traditions, dances, costumes, food, etc. Get tools like videos and images related to art like museums, buildings, sculptures, etc., in such a way that by the end of your presentation we all would like to visit that country. Do not use videos that are not authentic of that country.

 • Good sources to learn the culture of a country are videos of Rick Steve, Rudy Maxa or Burt Wolf

 • Always add the Works Cited Page with the correct format.

 • Leave a cushion of time for yourself. Finish your presentations as soon as possible after it is assigned. • Be very cautious using absolutes (“always” and “never”). Few things in this world are all or nothing.

 • Proofread multiple times, using proper grammar. Remember that in college, anything that is turned in, should be “publish-ready,” meaning completely free from spelling and other mechanical mistakes. 

• Cite any ideas that are not your own (including the text’s, the professor’s, or your neighbor’s). 

• Italicize complete works of art (e.g. Homer’s The Iliad, Botticelli’s Birth of Venus).

 • Use apostrophes if something belongs to someone (e.g. Hektor’s sword). Do not use apostrophes if something is plural (e.g. the 1800s.)

Organizational Problem:

Blaze Mining is a mid-size, family-owned oil and mining company located in Louisiana. Over the past 10 years, leadership of the company has fractured and become antagonistic. Non-collaborative internal teams have caused great damage to the management and operation of critical functions within the organization. Recently, a new CEO joined the organization and was stunned by the discord within the leadership team and its effect on the bottom line.

Organizational Design:

Blaze Mining is family-owned and managed. There are multiple divisions and departments pertinent to the type of operation occurring: Mining, Oil, Off Shore, Human Resources (HR), Finance, Education, and Safety. Each section is led by a family member and a personally selected team. The CEO is the overseer of the company.

Challenge and Request Criteria:

For the company to survive, the problems within the leadership team must be identified and addressed in a professional manner. The CEO of Blaze Mining is requesting an OD intervention to interact with the leadership group and develop a cohesive team focused on the success of the organization. The intervention is to include

  • three workshop sessions, once a month, for three months;
  • specialized intervention with each division/department; and a wrap-up session with all stakeholders

The paper must be four to five pages in length, and include level headings to lead the reader through the specific areas of content. Level headings also provide the reader with an outline to ensure all areas of the project are covered. Read the following case scenario:

The former Sameer Shariff, a Saudi Arabian national who changed his name to “The Left Hand of God” and is known to his followers as “Hand,” is a suspected terrorist. Department of Homeland Security (DHS) agents believe that he is planning an imminent attack somewhere in Capital City. Under duress to prevent the attack, three DHS agents and three FBI agents storm into Hand’s house, burst into his bedroom, where he is in bed with a woman, and point shotguns at him. They demand to know what he is planning. No Miranda warnings are read. Hand tells them that he has hired Alex “Boom Boom” Jaxon, a known explosives expert, to plant a bomb in the Capital City Arena, with a timer to go off in three hours when the arena will be filled with over 20,000 people for a music concert.

Jaxon is known to the police and is in Central City, which is two hours away. He is arrested by Central City police and calls his lawyer in Capital City, who tells him he will meet him there and to remain silent. The lawyer then tells Central City police that they are not to question Jaxon until they arrive in Capital City and the lawyer is present.

Central City Police Officer McFadden drives Jaxon to Capital City. McFadden knows that DHS, FBI, and Capital City police are searching the arena, but McFadden is afraid they will not find the bomb in time. By the time that McFadden and Jaxon arrive in Central city, the concert hall is already full of audience members, and the show is set to begin in twenty minutes.

McFadden, who knows Jaxon’s family from previous police contacts, tells Jaxon that his mother and two brothers, who have been surveilled by the police for the last six weeks, are at the concert and will die if the bomb goes off. Jaxon leads McFadden to the bomb, which is defused. A crying Jaxon states that his purpose was to kill infidels, but he would never harm his family.

Research Fifth Amendment cases, including Miranda v. Arizona, 386 U.S. 436 (1966), which involves custodial interrogation and the right against self-incrimination.
