Introduction

Organizational policy alignment and adherence to laws and regulations is critical for overall corporate compliance and to decrease organizational risks (patient falls, medication errors, cyber hacks and PHI data breaches, infection control, et cetera). In this assignment, you will select, evaluate, and update one health care provider’s policy related to a significant regulatory risk to the health care organization.

Instructions 

Select one of two options:

Option A

If you work for a hospital or health care organization you may select a policy that is of interest to you then follow these assignment instructions:

  • Imagine you are a health care administrator at your current employer. Analyze the policy you selected, taking into consideration any recent changes. Evaluate what information and where that information would need to be updated. Propose revisions that are based on current identified standards and/or new guidelines that you have researched in the text or identified in other high-quality sources (that is, journals, government websites, and the like). Analyze the significance of the selected policy updates as it relates to potential litigation. (Why did the policy need updating? What threats do these changes help avoid?) Summarize your perspective on the revisions as well as any additional changes that should be considered. Present your work as an executive summary suitable for distribution to your organization’s board members.
Option B

If you do not work in the industry or do not have access to a health care policy, use the  Hahnemann Falls Policy to complete this assignment. Then follow these assignment instructions:

  • As you can see, this policy was written in 2012. Now, imagine you are a health care administrator working at the health care organization where this policy originates from. Analyze the policy, taking into consideration the changes in HIPAA and PHI since 2012. Evaluate what information and where that information would need to be updated for a current revision of this document. Locate the areas where you would update or add information to this 2012 version. Propose revisions that are based on current identified standards and/or new guidelines that you have researched in the text or identified in other high-quality sources (that is, journals, government websites, and the like). Analyze the significance of the selected policy updates as it relates to potential litigation. (Why did the policy need updating? What threats do these changes help avoid?) Summarize your perspective on the revisions as well as any additional changes that should be considered. After you gain familiarity with the Eclipse environment, you are  going to write a very simple Java program, and run it using Eclipse.  Following is the sample code.

Note that the name of the following Java program is HelloWorld.java.  The spelling of HelloWorld must be exactly the same as to the word next  to “public class.” Be careful about the upper and lowercase, in Java,  uppercase and lowercase does make a difference. And by tradition, the  first letter of the class should be in upper case.

Case Assignment

Write a java program to display a greeting message and name it as  greetings.java. The message needs to include the following information:  your name, city you live in, your profession, and what you would like to  do in your spare time etc. Once you are done with debugging and running  the program, copy a screen shot of the output along with the java  program, paste it to a word document, and submit the word document to  dropbox.

Apossible solution for preventing and mitigating similar breaches using a defense in depthmodel will be presented using a multi-layered security strategy.A series of steps were taken by the adversaries to obtain access to the credit carddata and retrieve it from Target’s systems. A break down in detection further increaseddata loss. Sources suggest the breach transpired as follows:Reconnaissance by attackers may have included a Google search that would have supplied a great deal of information about how Target interacts with vendors. Results would have revealed a vendor portal and a list of HVAC and refrigeration companies. This reconnaissance would have also revealed a detailed case study on the Microsoft web site that describes how Target uses Microsoft virtualization software, centralized name resolution and Microsoft System Center Configuration Manager (SCCM), to deploy security patches and system updatesFrom this pivot point the attackers could have further infiltrated the network. The specific details are not available but we can speculate that the criminals used the used the attack cycle described in Mandiant’s APT1 report to look find vulnerabilities in the vendor portal move laterally through the network via back doors, reconnaissance and other vulnerable systems. Common network tools were used to do reconnaissance once inside the networkWhile the attack was in progress, monitoring software (FireEye) alerted staff in Bangalore, India. They in turn notified Target staff in Minneapolis but no action was taken. ReconnaissanceNetwork Infiltration and CommunicationFailure to respond to FireEye alertsSeparation of duties could have prevented this threat.

Suggestions:An alternate outcome for the Target scenario was presented with Critical Controls in place. Steps taken by the attackers could have been stopped at many different points during the attack. Segregating the POS systems, end-to-end encryption, inventory of systems and detailed logging would have kept thieves away from credit card data. Proper encryption would have prevented card data from being read in memory. Adequate, welltrained staff with time to appropriately analyze logs would have uncovered the malware and network traffic to mitigate losses had the breach still occurred

Importance of separation of duties  As the business grows so does the increase in levels of hierarchy of the company .This shows that any task cannot be done by a single individual , if done so that consumes most of the time to complete an operation . So segregation of duties creates an ease in business processes to get the tasks done efficiently and effectively and expose the risks involved in any particular task that are being carried out in any organization by a single employee i.e., for example, if transaction , billing and closing for a particular task are done by single individual , there is a risk factor involved of that individual exploiting the system  and can become unnoticed by any other employee or employer of the company. So any duty should be done by at least more than a single individual so that , the errors can be caught and prevent internal fraud in the business. Duties can also be segregated to assure that the transactions are correct , reported with accuracy and are adhering to rules and regulations of the company.Management and its review to determine proper segregation of duties  Management can record the end results of both prior to separation of duties and post separation of duties  and perform a final assessment to determine if duties are properly segregated or not.Challenges of management having inadequate staff  Not all processes require highly qualified personnel . So, few duties may just be  mitigated by imbibing mitigation controls in the system.Duties which can give us a least risk can be reduced by introducing mitigation controls into the system.Real time scenario and views on it On May 2013 , Edward Snowden’s whistle blowing regarding NSA ( National Security Agency ) documents can be taken as an example that might have mitigated threat to NSA , if proper prior strategies like segregation of duties are put into its system . According to ABC news , “Snowden was earlier appointed as a contractor with NSA who managed to download and steal an estimated 1.7 million confidential files”. According to Reuters , International News Agency’s article,Russian President said that “Snowden leaking the secrets is wrong but he is not a traitor “.The leak created direct or indirect knowledge gain among the public regarding the NSA surveillance operations.President Obama then urged to segregate a panel consisting of 5 experts to deal with the issue.The panel prepared 300 page report for the President with 46 recommendations which were far reaching .  To conclude , I would recommend being proactive instead of being reactive to the issue by practising strong internal controls, applying transparency in organizational processes,segregation of duties for all the tasks that are being performed in its operations and implementing employee evaluation practice under scrutiny to avoid internal threats in the organization.Thank You

Search and Review Literature related to Mobile Computing

 As with most areas of computing, security in mobile computing is a  paramount concern. This includes securing the user’s information on the mobile device, encrypting the information during the transmission of the data to the server, and securely storing this information on the backend server. Security vulnerabilities in mobile computing may not only affect a user’s perception of an app but may also leave an organization open to legal and ethical dilemmas.

One manner in which mobile apps provide security and privacy to a user is through their use of permissions. On both Android and iOS devices,  permissions protect an app from accessing sensitive information or functionality—such as reading SMS messages, accessing a user’s contacts,  or placing phone calls. App permissions have received a significant level of research in recent years from a variety of perspectives,  including user comprehension of permissions and using permissions to properly protect against malicious software.

An  older, but still very popular, work available in the NCU ACM Library is  titled “Android Permissions Demystified.” Please read this work,  included in this week’s Books and Resources, to understand some of the primary challenges related to mobile permissions and security. Your task for this week is to use the NorthCentral University Library and find a recent (published within the past two years) work that discusses any area of mobile permissions, including user perception/compression, malware protection,  updated permission models, or best practices. Essay Topics:  Choose ONE of the following topics.  If you want to write on a topic other than one of these, you need to discuss it with me first.

A principle of non-interference (such as Star Trek’s “Prime Directive”) is a common feature of science fiction stories involving contact with alien cultures.   However, it is very hard to follow a principle of non-interference, especially when one (human or alien) group is clearly damaging the interests of others.  Do you think that a principle of non-interference should be absolute, without any exceptions? If not, what kinds of criteria or considerations should guide when to interfere?  How would you respond to a challenge that your criteria are merely your own cultural biases?

3. Imagine that you have discovered a Ring of Gyges, or Harry Potter’s invisibility cloak. Now apply either Existentialism or Virtue theory.  If nobody would know that you were the person who did something, what sorts of things would you likely choose to do? What do you think you SHOULD do? Why?

4. Consider the distinction between intrinsic and instrumental goods.  What (if anything) do you think is intrinsically valuable?  Explain why.

5. Existentialism declares that we have radical freedom; evolutionary theory claims that various behaviors are wired into our DNA, and other theories note how we are shaped by cultural norms.  Using what we have read and discussed so far – and NOT getting into the complicated metaphysics of free will and determinism (whew!) – how much freedom of choice do you think we humans actually have?  Put another way, which of the theoretical accounts of freedom/choosing that we have studied makes the most sense to you? Why?

6. Some ethical theories involve a vision of persons or selves as isolated, distinct and non-overlapping.  Other theories depict us as inherently interconnected, so that our “self” is partly formed by our relationships, community, environment, or other features in which we are embedded.  Which version of “self” makes more sense to you? Why?  What are the implications of this conclusion for you when you do ethics?

7. Hobbes and Locke give different accounts of the state of nature, which lead to different ethical conclusions.  Which author do you think offers the better account? Explain why.

8. Assess the list of rights granted in the UN Universal Declaration of Human Rights (in our slide set).  Is this list reasonable and/or realistic? How does the distinction between positive and negative rights affect your assessment?  Is there anything you would add? Are there any identified rights that you think are not justified?

9. Do you think that (at least some) non-humans should be granted rights like those in the UN Declaration of Human Rights? If so, what kinds of rights might apply to what kinds of creatures?  If not, why not? Focus on ETHICAL rights claims, not legal rights.

10. Compare the notion of ethical detachment as described in Buddhism &/or Hinduism with Existentialism’s insistence on authenticity and actively embracing our freedom.  Do you think these ideas are completely incompatible, or are there some overlapping insights?

Read the Discussion 06.2 Scenario. We will debate two related issues:

SCENARIO (BASED ON A REAL LOUISIANA CASE)

As your Pozgar textbook states, “The premature discharge of a patient is risky business” (p. 249). As the

text points out, improperly discharging patients is a very common basis for negligence suits against

physicians.

Scenario (based on a real Louisiana case): A patient with chronic kidney failure required continual

dialysis treatment. As such, hemodialysis catheters, also called access grafts, were surgically inserted in

the patient’s arms. These access grafts eventually caused problems and needed to be removed by a

vascular surgeon. After the procedure, the patient was hospitalized and he suffered two incidents

where he bled copiously from a surgery site in his left arm. The bleeding was stopped with pressure

dressings, and the patient received a blood transfusion. The patient was hospitalized for four additional

days for observation. He had no other episodes of bleeding, he received his dialysis treatment fine, ate

well, and had good vital signs—therefore, the patient was dismissed from the hospital. The physician’s

discharge summary noted the patient had been instructed on how to apply pressure if his arm should

bleed and was told to call his physician if problems occurred.

Upon returning home, the patient had two bleeding incidents. Pressure was applied and the site was

wrapped with gauze. No one called the physician to report the two bleeding incidents. The next day,

the patient was left alone while his wife went to run some errands. When she returned home about 30

minutes later, she found her husband dead, lying in a pool of blood. The patient died from loss of blood

caused by hemorrhaging from the incision in his left arm. His wife filed a wrongful death suit against the

physician, claiming that he never should have been discharged from the hospital.

.Group 1:  Students with last names starting with the letters A-M will represent the defendant physician and argue that the doctor was not negligent and/or he should prevail because of an affirmative defense he could raise at trial.

.Group 2:  Students with last names starting with the letters N-Z will represent the plaintiff and argue that the physician was negligent and that there is no affirmative defense that should excuse the physician from liability.

Each group member is required to debate their position based upon facts and research. Fully explain your reasoning, using legal principles you have learned and applying them to the facts of this case. Opinions offered without evidence are not welcome in this debate.
