Scenario:

Mario is a 30-year-old male who has been severely injured in a motorcycle accident. Mario has sustained extensive neurological damage, including the loss of higher brain function. He is being kept alive in an intensive care unit (ICU) by means of life-sustaining treatment that includes the use of a ventilator, feeding tube, and various intravenous medicines. In the room with Mario are his girlfriend, Johanna, and his parents, Troy and Wendy. Mario lives with Johanna and they have a child together, Agnes, age 4. However, since Mario does not have documented medical power of attorney and because he and Johanna are not married, state law holds that his parents have the authority to make medical decisions on his behalf.

Mario’s doctor, Eula Ellis, comes into the room to examine Mario and explains to the family that he is in a persistent vegetative state (Links to an external site.) (PVS)

 and that Mario is unlikely to recover. Gently reinforcing this last point, Dr. Ellis explains that the treatment Mario is receiving is keeping him alive, but it will not lead to any cure or recovery. Wendy points out that Mario sometimes opens his eyes and blinks when there is a loud noise. She wonders if that means that there is hope that he recover. Dr. Ellis says that, sadly, that’s not the case. These actions from Mario are brain stem activity – automatic biological responses – and are common with PVS. What made Mario Mario will not come back.

Dr. Ellis asks the family to consider what Mario would want. She suggests that they consider authorizing the withdrawal of all life-sustaining treatment so that Mario can die a “natural death”. A few hours after Dr. Ellis leaves, another doctor, Marcus Horton, and a social worker, Dawn Cunningham, enter the room and ask to speak with the family. Dr. Horton explains that he and Ms. Cunningham are part of the hospital’s Organ Procurement Team. They express their sorrow for what has happened to Mario. They ask the family to consider donating Mario’s organs so that other lives can be saved.

Perspectives:

Mario: The prevailing scientific view holds that Mario is not aware of his circumstances. He might have enough sentience to react to some stimuli such as light and sound. It is uncertain if he feels pain or suffering. Mario is incapable of communication.

Dr. Ellis: Having seen several tragic cases like this, Dr. Ellis believes that keeping Mario alive on life-sustaining treatment is futile. He will die. The family might need some time to come to grips with this difficult decision, but the sooner they make it, the better. Bodies typically don’t do well when they are kept alive for long and Dr. Ellis has seen some very difficult cases in which families kept patients like this alive for months.

Johanna: She is heartbroken. She is wondering what she will tell Agnes and how she will raise Agnes on her own. She worries that Mario is suffering. They had such hopes for their lives, and now he is so broken. She just wishes that he could be at peace.

Agnes: Johanna’s mother is caring for Agnes at the moment. She knows that something is happening and that people are upset. At four years-old, Agnes is just reaching the age where she can comprehend that death is irreversible. When Mario dies, she will be able to recognize that this is final and she will grieve.

Wendy: Mario’s parents are people of faith. They have participated in prayer circles through their church for people who have faced serious health challenges. Wendy believes that miracles can happen. She’d like to call upon the prayer circle at her church. Besides, she saw Mario’s eyes open and turn toward her when spoke. Doctors don’t know everything; they’re not God. She’s offended that Dr. Horton came by so quickly. Organ donation can wait until after they give prayer a chance.

Troy: He is facing the loss of his heir – his contribution to the future. Like Wendy, Troy would like to involve the church prayer circle. God determines when people die, right? Troy is also mad that those vultures came in looking for Mario’s organs. Those doctors would rather sell him than try to save him.

Marcus Horton and Dawn Cunningham: This is the worst part of the job – when families are reeling from the shock of what happened to a loved one who was perfectly healthy just hours ago. They realize that they come across as ghouls but timing is everything when it comes to organ donation. Organs don’t remain viable for long. Stopping life-sustaining treatment has to be coordinated with the harvesting of organs, and that has to be coordinated with the transport and transplantation of those organs. If the family is thinking about withdrawing treatment, then they also need to weigh organ donation in that decision. It’s a hard thing to ask of them, but other lives can be saved.

Facts

CZ Interiors, LLC specializes in interior design and interior decorating for residential and commercial properties in Silicon Valley. The company began as a family business in 1972. Today, it retains its headquarters in Morgan Hill Valley, California but has grown to over 150 employees. The current executive management team at CZ Interiors comprises 8 men and 6 women, some of whom are direct descendants of the original founders. Although they are politically conservative as a group, they and their employees believe the team to be fairly progressive when it comes to creating a healthy workplace that respects employee rights and work-life balance. In that regard, in early 2019 the team contracted with Internet Life Balance, Inc. to provide all employees a technology that allows work-time access to the Internet that is completely free of employer monitoring. This “sandbox” technology creates an isolated secure pathway to the Internet from an icon on employer desktops. Here, employees can check personal email, social media and the like. Because it is isolated, the technology also ensures that the company’s computer system will not be compromised by security threats and viruses. Internet Life Balance thus provides CZ Interiors with both a security solution and a way to honor employees’ personal privacy while at work.

Employees are encouraged to create community with each other by using Internet sites such as Instagram and Facebook in ways that allow them to connect with work colleagues. For example, many employees are “friends” on Facebook and/or follow each other in Instagram. Under its current technology use policy all CZ Interior employees are required to use Internet Life Balance for such personal Internet use while on site. Laptops and handheld devices are restricted from such use and, with the exception of cell phone calls and necessary text messaging, discouraged from workplace usage all together. Work related internet usage such as company email is excepted. Work-related Internet usage occurs via Microsoft Outlook for email and Internet Explorer, both subject to employer monitoring for possible misuse and protection of CZ Interior’s intellectual property.

With the exception of the executive management team, all employees at CZ Interiors work in open space on desktops that are not assigned to any particular individual.  Employees simply select a computer station, typically at the beginning of the workday.  Occasionally employees will select the same station out of habit, but generally the open space policy facilitates employee relationships by encouraging mingling and keeps the workplace from becoming routine.

In June of 2019, a small group of six employees who identify as LGBTQ approached the executive management team with a request that the company’s employee handbook be updated to recognize LGBTQ status as protected for purposes of gender discrimination including gender identification and sexual orientation.

The current employees handbook states that gender discrimination of any kind, including sexual harassment, will not be tolerated and includes a procedure for reopening incidents that is compliant with federal and state employment law. CZ interiors has not, however, provided employee training about the policy since 2010. There have been no incidents of reporting harassment of any kind since 2008.

When other employees found out about the change request, tension between camps in favor and against grew. Until recently the status of the LGBTQ employee requesters was not discussed openly at work. Although they assumed they would have the support of their colleagues, a group of five employees (the “objectors”) began a subversive campaign against their LGBTQ peers.

Using the private Internet access provided by Internet Life Balance, the objectors began posting comments on Facebook critiquing the request and in some cases commenting disparagingly about their LGBTQ co-workers’ gender identities and sexual orientation. The objectors used Facebook to call for unity against their LGBTQ co-workers and to take action to make work “so miserable” for them that they would be forced to quit. Most of the employees and five of the executive team were “friends” on Facebook and had full access to all the degrogatory posts. Over a period of 45 days,  Facebook analytics reveal that 4 of the 5 managers were online on Facebook over 30 times per user (based on registered logins). However, it is not confirmed if any viewed the objectors’ posts as there was no confirmed “likes” by management of the comments. Employee use of Facebook over that same period, on the contrary, reveals that at least 10 employees co-workers “liked” at least three of the objector comments.

By September 3, of the LGBTQ employees quit their jobs. These three were support staff. When they quit, they did not explicitly inform the executive manager in charge of HR about their reasons for quitting. However, they did each state in their exit interview with this HR manager that the workplace environment had become “uncomfortable and unsupportive” . The HR manager is one of the executive “friends” on Facebook who was online during the 45 day window noted previously. It is not clear whether he saw the Facebook campaign of the objectors or not.

The objectors continued their campaign on Facebook from work stations at CZ interiors until early November 2019 when they were served at work a summons and complaint by the six LGBTQ employee targets. The complaint also named the company and the executive management team as defendants. Simultaneously, the EEOC filed suit against the company for gender discrimination under Title VII.

The executive management team immediately suspended the five objectors until an internal investigation could be conducted. All employee access to Internet Life Balance was shut down. At this point, no action had been taken at all regarding the original request made some 5 month prior to modify the employee handbook to include LGBTQ status as a protected class. The task was delegated to the HR manager, but he had been consumed with other projects and when asked stated that he simply had not yet time to get started on consideration of the request or even time to talk to company counsel about it.

The complaint filed by the LGBTQ employees alleges against the five objectors for defamation, invasion of privacy and intentional infliction of emotional distress. It alleges claims against the company and the executive management team based on respondeat superior for the actions of the objectors; negligent supervision; and sexual harassment.

The objectors settled their cases with the plaintiffs confidentially. You are not to be concerned with analyzing this case. However, the case against CZ Interiors and the executive management team is proceeding, and as of today the Company has filed a motion to dismiss all three claims alleging that the plaintiffs have not presented enough evidence to support legal causes of action. You are the judge hearing this motion. Please provide an IRAC analysis for each claim (respondeat superior, negligent supervision and sexual harassment) against the company. Use the facts presented here as you deem relevant to decide if you will grant the company’s motion, or allow the plaintiffs’ case to proceed to trial.

#1: A 9-year-old boy is helped to the nurse’s office at school because he is having difficulty breathing after playing outside on a windy, dusty day.  The nurse is aware the child has asthma and he has an inhaler for him.

#2: A mother has come to urgent care with her 8 year old daughter because of a rash and swollen joints.  When asked about past illnesses, the mother relates that the daughter recently had a cold and sore throat but they went away.  She never took her daughter to the doctor, just kept her in bed a couple days wiht a fever and had her gargle with warm salt water.  Mom states to you, the nurse, “all the kids are sharing and no need to run to the doctor .  It will go away eventually.”

Your paper should be written in the third person taking the individual out of the writing and avoiding pronouns such as I, we, my, our (first person) and you, yours, your, us, we (second person). You should deal with facts and not opinions, thus providing citations within your paper and on your reference page. Focus on the subject itself and not on your feelings about the subject. The use of the third person retains a formal tone in your writing. The use of first and second person can make a document seem more casual. The paper should be complete and the main body should be 1000-1500 words in length (excluding cover page, abstract, references, etc.). Utilize APA Style format and references.

Question One (15 Marks)

Banks to slash extra 1000 jobs

On 21st August 2002 the Commonwealth Bank (CBA) announced that it would slash 1550 jobs while creating 550 jobs, a net loss of 1000 jobs. It planned to reduce inefficient operations, task duplication & some back-office processing functions, but stated that it would not close more branches even where closures had been planned. The news received hostile reactions from both unions and consumer advocates like the Australian Consumers’ Association (ACA).

Union officials said that the job cuts were scandalous, and that bank staff were suffering from uncertainty following previous cuts and closures. It is unbelievable’ said Tony Beck, Finance Sector Union national secretary. They have just shed 500 jobs, all from the retail network. Now we get this punch with another 1000 jobs.’

The ACA was equally unimpressed. Its finance policy officer Catherine Wolthuizen asked when the losses would stop. How much profit is enough for greedy banks like CBA and how much further will it flout consumer and community demands before the Government acts?’

The ACA wants a social charter set up to delineate minimum standards around access to banking and affordability. It has been lobbying the Federal Government to act for consumers in the face of massive bank profits.

CBA’s annual profit leapt 11percent to $2655 billion in the previous financial year, increasing income (over $1.8m) from fees, commissions and other charges contributing to the profit surge. The strong housing market contributed to an increase in lending fees income: $618m, up 3percent. Commissions and other fees raised a massive $1.242 billion, up 6 percent.

Explain whether you think the banks would or should respond to the concerns of the ACSA and/or concerns of the Finance Sector Union. What theory(s) did you rely on (if any) to form your judgement?
