Contract analysis scenario one—damages determination: Alfred and Barbara own adjoining farms in Dry County, an area where all agriculture requires irrigation. Alfred bought a well-drilling rig and drilled a 400-foot well from which he drew drinking water. Barbara needed no additional irrigation water, but in January 1985, she asked Alfred on what terms he would drill a well near her house to supply better-tasting drinking water than the county water she has been using for years. Alfred said that because he had never before drilled a well for hire, he would charge Barbara only $10 per foot, about one dollar more than his expected cost. Alfred said that he would drill to a maximum depth of 600 feet, which is the deepest his rig could reach. Barbara said, “OK—as long as you can guarantee completion by June 1, we have a deal.” Alfred agreed, and he asked for $3,500 in advance, with any further payment or refund to be made on completion. Barbara said, “OK,” and she paid Alfred $3,500.

Alfred started to drill on May 1. He had reached a depth of 200 feet on May 10 when his drill struck rock and broke, plugging the hole. The accident was unavoidable. It had cost Alfred $12 per foot to drill this 200 feet. Alfred said he would not charge Barbara for drilling the useless hole in the ground, but he would have to start a new well close by and could not promise its completion before July 1.

Barbara, annoyed by Alfred’s failure, refused to let him start another well. On June 1, she contracted with Carl to drill a well. Carl agreed to drill to a maximum depth of 350 feet for $4,500, which Barbara also paid in advance, but Carl could not start drilling until October 1. He completed drilling and struck water at 300 feet on October 30.

In July, Barbara sued Alfred, seeking to recover her $3,500 paid to Alfred, plus the $4,500 paid to Carl.

On August 1, Dry County’s dam failed, thus reducing the amount of water available for irrigation. Barbara lost her apple crop worth $15,000. The loss could have been avoided by pumping from Barbara’s well if it had been operational by August 1. Barbara amended her complaint to add the $15,000 loss.

In a minimum of a 1,000-word contract analysis, discuss Barbara’s suit against Alfred. What are Barbara’s rights, and what damages, if any, will she recover?

Contract analysis scenario two—remedies determination: Mundo manufactures printing presses. Extra, a publisher of a local newspaper, had decided to purchase new presses. Rep, a representative of Mundo, met with Boss, the president of Extra, to describe the advantages of Mundo’s new press. Rep also drew rough plans of the alterations that would be required in Extra’s pressroom to accommodate the new presses, including additional floor space and new electrical installations, and Rep left the plans with Boss.

On December 1, Boss received a letter signed by Seller, a member of Mundo’s sales staff, offering to sell the required number of presses at a cost of $2.4 million. The offer contained provisions relating to the delivery schedule, warranties, and payment terms but did not specify a particular mode of acceptance of the offer. Boss immediately decided to accept the offer and telephoned Seller’s office. Seller was out of town, and Boss left the following message: “Looks good. I’m sold. Call me when you get back so we can discuss details.”

Using the rough plans drawn by Rep, Boss also directed that work begin on the necessary pressroom renovations. By December 4, a wall had been demolished in the pressroom, and a contract had been signed for the new electrical installations.

On December 5, the President of the United States announced a ban on foreign imports of computerized heavy equipment. The ban removed—from the American market—a foreign manufacturer that had been the only competitor of Mundo. That afternoon, Boss received an email from Mundo stating, “All outstanding offers are withdrawn.” In a subsequent telephone conversation, Seller told Boss that Mundo would not deliver the presses for less than $2.9 million.

In a minimum of a 1,000-word contract analysis, discuss the following questions: Was Mundo obligated to sell the presses to Extra for $2.4 million? Assume Mundo was so obligated. What are Extra’s rights and remedies against Mundo?

Decision-Making in Nursing Leadership

Nursing leadership requires critical thinking and high cognitive ability as one has to make decisions regarding patient care, nurses’ welfare, and team development. Nurse leaders make decisions regarding nursing practice, evidence-based practice, and points of advocacy in my organization.

While nurse leaders focus on ensuring nurses perform per the organization’s expectations, they also advocate for nurses’ and patients’ welfare. For instance, nurse leaders had to advocate for nurses’ safety, especially as they handle COVID-19 patients, ensuring they get the necessary personal protective equipment (Majers & Warshawsky, 2020). Ensuring nurses have adequate personal protective equipment further guarantees patients’ safety and improves the quality of care as there is no transmission of the virus from one patient to another.

Nurse leadership focuses on issues affecting nurses, patients, and the healthcare organization. As a result, effective leadership among nurse leaders secures their decision-making on healthcare setting issues (Sfantou et al., 2017). Effective leaders identify problems in their space, gather views on how these problems can be solved, and communicate the recommendations with nurses and organizational leaders. As a nurse leader, I can be invited to the table and be an active participant in decision-making by demonstrating effective leadership and being proactive in finding amicable solutions to arising issues.

In summary, my organization makes decisions in a centralized manner where leaders decide on the way forward and communicate the recommendations to team members. While this organizational structure appears inclusive for all leaders, only effective leaders take the lead in making critical decisions regarding practice in their areas of practice.

In nursing, proper decision-making is essential because it aids in the collection, storage, and processing of data and the provision of knowledge and information. In carrying out and managing their activities and when working with patients, nurses depend on decisions made across all managerial levels (Namnabati et al., 2017). As one becomes more knowledgeable of the profession’s decision-making process, new responsibilities and tasks emerge in the nursing sector. As a result, nurses will have to choose the right decision that best suits their needs (Ellis, 2017).Because of the scope and variety of nature programs in health care, nursing leaders must first consider the underlying conditions before making any decisions. According to Nammabati et al., (2017) the ability to acquire decision-making skills that are valuable to the profession is dependent on their knowledge of hospital information networks. Decision-makers who play a role in enacting different positions in the hospital hierarchy, such as charge nurses, directors of nursing, and managers, would be able to engage in successful critical decision-making if they are equipped with a thorough understanding of all healthcare processes and structures.Another essential role in nursing is mobilizing the best participants to address sensitive topics in a group setting. In research from Ellis (2017), this role is critical in coordinating data processing and other decision-making in nursing unit communication. Political considerations often influence decisions, and as a result, they may be tainted. Namnabati et al., (2017) found that when employees participate in the decision-making process, a successful method is more likely to develop. For efficient planning and execution, adequate resources such as skills, people, and time must be allocated.Nurses play a critical role in the decision-making process and the appropriate order for communications systems to monitor patient data from the moment of admission until they are discharged by streamlining data processing at each stage of the patient’s hospitalization. Namnabati et al., (2017) argued that the connection between the clinical groups, patients, pharmacists, and physicians, nurses play an essential role in the healthcare setting to collaborate to increase patient outcomes. As members of the hospital’s committee, the nurses are responsible for conducting an audit and making recommendations on the procurement of clinical tools, systems, and essential services (Ellis, 2017). Nurses, in particular, communicate with other practitioners and work with multiple teams of professionals within a hospital. Nurse educators can raise questions about how nurses can gain knowledge and assist in implementing training by supplying valuable resources.In conclusion, decision-making is critical in the area of nursing. By involving nurses in the decision-making process, which are essential resources in streamlining the workflow, some significant opportunities for improving patient safety and patient outcomes improve. As a result, nurses play a crucial role in the executive teams by providing practical options during decision making, which help the healthcare systems efficiently conduct clinical processes and, most importantly, support the nursing staff. They must discuss all of the system’s clinical elements, with a clear understanding of how the system will impact the nurses’ workflow and how the system will improve patient safety while still optimizing the nurses’ productivity.

General Computer and Application Controls of BestBuy

Required:        

1.  Analyze   the general computer controls (GCC) and application controls of an E-commerce   website that you use frequently or are otherwise familiar with.    

2. Attempt to complete a   transaction, or transactions, through the website, taking screenshots of the   transaction progress. Proceed with the   transaction(s)    

3. as far as you would like   through the purchase process using either real information (black out   personal information on the screen shot when turning in the assignment) or   fictitious information.    

4. Next, test the various input   controls and document your findings. Analyze the types of front-end input controls that are in place and   the effectiveness of those controls.    

5. Also analyze the backend   theoretical processing of the transaction(s) and further relevant GCC and   application controls all the way from initiation of the transaction to the   updating of the company’s GL.    

6. This will require making some   assumptions, as the company’s system is not available for you to access.   Please analyze both the processing and controls, including the important data   sets that will be utilized by the company to   update the GL. 

7. Finally, provide any   recommendations for improvement   related to the controls you   tested or would have tested. Print out your analysis and turn in a hard copy   in class, along with the screenshots as exhibits.   

* Make sure you are very   detailed as to the types of transactions, activities, processing and controls   that relate specifically to your chosen E-commerce experience (company).    

*This should pertain to the company you   have chosen to analyze and it should not be a generic analysis. There is no specific length requirement,   but make sure that each topic is adequately discussed.

This journal is a little different. We have now studied several different artistic media, so we’ll combine it all together.

Then we will do some curatorial work – meaning, evaluating the show and an individual work within it for a series of class awards we give out.

In your journal entry please choose one work and come up with an award for it. We’ll share the most thoughtful awards with the artists. Here is what you award submission should include:

1. Title of the award. (examples: “Best Drawing Award”, “Most Innovative Use of Linear Perspective”, “Form and Content” award, or make up your own.)

2. Title of piece and name of artist you are choosing for the award

3. Explain in about a sentence what the award means (artists may not all know what linear perspective is, for example)

4. Explain in about a sentence why the piece you chose has, in your mind, earned the award. What about it stands out and why? You can think of this as a visual analysis as well. Consider that the artist will learn something new from your interpretation of the work, so this is your chance to share knowledge from the class with them. Many of these artists have not taken the Art in Life course.
