Since we have the freedom to discuss any concept from our readings, for this post I would like to address the use of technology in human trafficking. Traffickers use any type of means necessary to accomplish their trafficking goals and one of them is the usage of the Internet. Kakar mentioned the famous site Craigslist and old one Myspace as online platforms that have been used in the past for human trafficking purposes (2017). The Internet is providing many ways for the business to continue to grow and the traffickers get creative with the resources available online. For instance, traffickers will post advertising content to attract nannies, models, dancers, etc.… luring them into their operations (Kakar, 2017). Another component of technology in this criminal business is the purchase and manipulation of disposal phones. This keeps communication flowing while maintaining their incognito profile and not getting caught. Current mobile phones have a feature that transmit false identification allowing these offenders to get as many phones as desired (Kakar, 2017).

Additionally, in the same context of Internet and technology, a service that has been used to recruit females is the mail-order bride. Kakar pointed out that research has been done on the subject reporting that the mail-order bride sites may involve sexual exploitation and purchase of online victims (2017). A few years ago, during a United States Senate hearing, this service was found to be associated to human trafficking, which validates the point, this so-called service has been a front for all types of trafficking to take place. (Kakar, 2017)

At the end, there are efforts being made to combat human trafficking online. The Convention on Cybercrime, the Interpol, the G8 Sub-group on High- Tech crime and the Virtual Global Taskforce are a few global efforts to terminate the human trafficking business (Kakar, 2017). In the past, the Interpol has rescued many human trafficking victims; more than 2,700 were released from their traffickers. This encourages for regular citizens to take part and be active if needed and say something if they see something.

The Value of Fair Treatment in the Workplace

You have been hired as a management consultant by a large company to examine the company’s business decisions regarding employee protections. The applicable laws are federal anti-discrimination laws, federal health and safety laws, and employer firing practices related to the employment-at-will (EAW) doctrine.

In response to the three questions below, write a 4–6 page paper in which you do the following:

  1. Analyze, identify, and explain recent legislation, within the last 10 years, that helps to protect employees from discrimination in the workplace. Provide at least two federal legislative protections. Provide some insight when the federal legislation conflicts with the state.  
  2. Explain the EAW doctrine and all exceptions to the doctrine. Look at the scenarios below and determine whether the decision to fire the employee is a smart one. Identify why or why not, and determine all the possible exceptions per the EAW doctrine that are, might be, or could be applicable if the employee sues for wrongful termination.
    • Brenda, a manager, started a blog on the company website for employee grievances. She noticed that a worker was protesting that no Asian American employees had gotten a raise in two years at the company. The worker also criticized how much the CEO made and how the CEO was “out of touch.” Brenda reprimanded the worker. The next day, the worker talked to fellow co-workers about forming a union. Brenda subsequently fired the worker.
    • Jason, a department supervisor, requests approval to fire his secretary, Alice. Alice, a devout Christian, has been putting Right-to-Life flyers in the employee breakroom. Alice is also taking time out to pray each day during the busiest time of the morning.
    • Brian, the head of the accounting department, refused to sign Lori’s leave request for jury duty. Lori is a tax attorney in his department. Brian wants to fire Lori for being absent without permission during their busiest time—tax season.
    • Peter has worked for the company for one year. He has a rare form of liver disease and works with chemicals that make his condition worse. Peter does not want to stop working, but his boss is not happy with his performance and wants to let him go.
  3. Determine the federal law regarding undocumented workers and whether they are eligible for state workers’ compensation in the United States. Advocate for or against this practice and substantiate your response with research to support your position.

You are a corporate safety director who has been asked to provide a training session to 23 Otto’s Oil & Lube franchise owners and managers on how the Occupational Safety and Health Administration (OSHA) operates and what to expect from an OSHA inspection. Eight of the managers work in state-plan OSHA states. Put together a PowerPoint presentation that describes the responsibilities of safety and health regulatory agencies and discusses the OSHA enforcement process, citations and penalties, and different ways owners might deal with citations if any are received from an OSHA inspection.  You are the owner of a company (306 SPORTS INC.) that produces a new, technologically advanced skateboard. This board is smaller and much faster than any skateboard ever created. Your creation has become the best selling sports product in the country, with many extreme sports stars buying, using, and promoting your new skateboard. You are making millions for you and your shareholders! 

Because of its capability for tremendous speed, the “Rocket Board” is considered an extremely dangerous board. In the past year, several customers, some as young as 5 years old, have been injured while riding the “Rocket Board.” Injuries range from bumps and bruises, to broken arms and legs, to concussions. 

Some pediatricians and politicians claim your product should be recommended only for advanced riders, preferably over the age of 18. And, they want a warning label printed on the package. But, these restrictions and warnings would, of course, hurt your sales and profits. 

Your company also faces several lawsuits and tremendous public criticism because of the injuries sustained by some users of your product. The public is calling for you and your company to take responsibility for the injuries your product has caused. 

Some want 306 SPORTS INC. held financially responsible for creating a product that you knew to be dangerous to many users/customers. Many critics have said creating a product such as the “Rocket Board” is unethical because skateboards are traditionally children’s toys and your product is causing harm to many young consumers. 

As owner of 306, it is time to answer your critics. How do you plan on defending your company and its reputation and make critics happy? How do you plan to maintain sales and keep employees, investors, and shareholders happy? 

 YOU HAVE TO: 

• Explain your plan to answer your critics who claim you are responsible for the injuries and your company has behaved unethically. 

• Explain what you are going to do about the current lawsuits filed against your company and any lawsuits moving forward. 

• Finally, explain what steps you are going to take to make sure the Rocket Board’s sales continue to grow and your company remains profitable so your investors and shareholders have confidence in your leadership. 

This is how I want you to approach the research aspect of this assignment. Find three or four sources that help you make your case to the reader.

So, you are required to do several things – anwer your critics about the safety of the Rocket Board and the  “ethical” nature of your company; explain what you are going to do about the current lawsuts; and what you plan to do moving forward to keep 306 SPORTS INC profitable.  You need to use research to convince the readers (306 SPORTS INC community) your plans and ideas are sound. The research you add is, of course, up to you, but I want it to be legitimate. Find actual sources that support your ideas.

Consider, hypothetically, a small community called Plainsville, Colorado, which has a critical rail line running through it. On this line, hazardous chemicals are routinely transported en route to a neighboring community (Southtown) where they are crucial for industrial use in manufacturing a certain type of nuclear defect x-ray material that is made nowhere else in the world. The rail line was first laid in the late 1800s and has been patchily maintained over its life. 

Given new priorities through Department of Homeland Security (DHS) Grant Programs and state mandates, both the Plainsville community leaders and operators of the railway are concerned with increasing vulnerabilities associated with rail transport because there is evidence of structural decline due to its age and uneven maintenance. Serious damage to, or degradation of, the line in the vicinity of Plainsville might be catastrophic with worst-case consequences including: irreparable destruction of the rail; a train derailment; a chemical spill; the creation of a hazardous environment for people, livestock, and agriculture; disruption of the industrial manufacturing in Southland; and the possible economic crippling of the entire area. Any of these components alone could result in a crisis; yet a combination of these, or if combined in totality, would be a scenario considered unimaginable by Plainsville’s leadership and emergency management personnel. 

By way of background, Plainsville has a “strong” mayor, meaning she is elected by the people rather than chosen by a council, etc. Based upon DHS grant dollars that have trickled down through her state and all-hazards homeland security region, Mayor Witley has determined that a commission in the form of a short-term task force should look at the vulnerabilities associated with the rail line. The commission would take the scenario outlined above, consider its many variations, study possible consequences while articulating and researching the problem(s) and receiving testimony from experts, and then make recommendations about courses of action to prevent, mitigate, or respond to any resultant crisis.

The issues at hand for the community include the integrity of the rail line, the prevention of a hazardous spill, the safety of the citizens, and the continuity of the neighboring town’s industry. (More issues may exist, but this gets you started.) 

  • Consider and list at least 10 potential organizations that would either provide a representative to sit on the commission or that would provide information to the commission.

Review the short case below and  answer the questions listed below as a basis for discussion with your classmates.  Guidelines are to complete each post before the due date with a minimum of 75 words. Love’s Travel Stops and Country Stores, Inc. v. EEOC 

Two young female cashiers sued Love’s Travel Stops due to sex-based abuse by customers. The cashiers were sexually harassed by truck drivers, some of whom were regular customers of Love’s.  The conduct included unwanted touching and pressing, crude and obscene remarks, sexual innuendos, and demands for personal information.  Love’s knew about it but their managers claimed that harassment was to be expected because it was a truck stop and nothing could be done about it without it becoming a financial burden due to a loss of customers.
