The Exclusionary Rule

You are a new law clerk working for one the popular justices for your state supreme court. You were recently invited to present a presentation on the exclusionary rule to the state police in order to assist them in reducing the number of errors made and increasing their effectiveness while on duty.

In the Discussion Area, please respond to the following questions and explain how you arrived at your decision. Review the decisions of at least two of your classmates and respond to what they have written. Be sure to respond to any feedback to your original post:

  • Provide a clear definition of the exclusionary rule.
  • Describe how the exclusionary rule might influence the behavior of police officers, detectives, and prosecutors.
  • Recall the scenario in last week’s discussion. Assume that Chip told police that he stashed the bodies but was only doing what Bob, the owner, told him to do. If he revealed this information under questioning, but without having been given his Miranda rights, how would that impact the case?
  • Do you think it is more important for judges to always enforce the exclusionary rule, or should exceptions be made so that violent criminals are not set free despite being guilty? Explain your reasoning.

Book Walk Lesson Plan

  

Planning effective English language arts lessons many times includes focusing on multiple literacy skills, aligned to state or national standards, while incorporating interesting, student-centered materials. When focusing on reading, it is essential to model metacognitive strategies, before, during, and after reading, including relevant vocabulary. A book walk is a powerful pre-reading strategy that can be used at all elementary grade levels. This strategy exposes students to a new piece of literary or informative text, while predicting text content and exploring vocabulary.

Throughout this course you will be creating a literature unit based on one piece of grade-appropriate literature (fiction or non-fiction) that includes all areas of reading development. Select a piece of literature suitable for the students in the “Class Profile.”

Single Course Design

 Now that you have a partial draft of the domain and competencies and you have them aligned to activities that students could complete, it is time to consider a particular course that students may need to take if they were in this program. For this activity, you will use the syllabus template in the Course Materials section to write a draft of a course that will ultimately be developed into a syllabus for that course. Choose two to three competencies from your domain and competencies document for this course to focus on. This is something you are creating and should be unique. 

Your draft should contain the following:

  1. Course Title
  2. Course description
  3. Two to three programmatic competencies that will be covered in the course
  4. Eight possible topics
  5. One or two objectives for each topic (keep in mind that you already outlined possible activities and that your objectives need to align with the competencies and activities assigned to the course)
