What is assistance of counsel?

For example: Two college friends, Richard and Peter are arrested by the Capital City police. They are accused of murder for setting fire to the Capital City University administration building one night and causing the death of a janitor in the fire. Both Richard and Peter were members of a student organization that claimed that the administration of the University was corrupt, and at a rally they carried signs outside the building that read “Burn it to the ground.”

Richard’s father is very rich. He hires a team of the most expensive lawyers in the country, and after an eight-day trial, Richard is acquitted by a jury. Richard’s lawyers sought and received a separate trial for him.

Peter’s parents have no money, and Peter has massive student loans and works two jobs to pay for school. He is represented by a public defender who has 120 other cases. Though the public defender does his best with limited time and resources, Peter is convicted after a three-day jury trial.

Peter is now appealing his conviction, claiming that having a public defender with 120 cases effectively denied his right to counsel.

Was this a violation of Peter’s Sixth Amendment right to counsel? Fully explain your answer. Be sure to support your answer with scholarly sources and appellate court opinions. Introduction

Our nation has been a melting pot of cultures since its birth and this multiculturalism is increasing rapidly. This diversity is creating a significant challenge for interactions at all levels of society, particularly in healthcare. In order to meet this challenge,  advanced practice nurses must first understand the concept of culture, as well as health and illness.

Culture is defined by Dayer-Berenson, as “the shared values, traditions, norms, customs, arts, history, folklore, and institutions of a group of people who are unified by race, ethnicity, language, nationality, sexual orientation, and/or religion.”(2014). In order to help our patients connect with their healthcare providers, it is vital as advanced practice nurses to provide culturally sensitive and competent care. This will help us identify healthcare disparities and their impact on current health care in the United States.

Topic 1: Health and Illness

The concepts of health and illness are not easily defined and are difficult to understand. The World Health Organization (WHO) defines health as “a state of complete physical, mental, and social well-being and not merely the absence of disease.”  Other definitions include the state of being free from illness or injury or a general condition of the body or mind in equilibrium. The many definitions of health make it difficult to grasp and understand its meaning. The definitions of illness are just as elusive. Is it the absence or opposite of health or is it better defined as a disease or condition?  No matter the definition we need to understand that the experience of being ill is also defined by the patient.   What health may mean to a 21-year-old athlete versus a 60-year-old diabetic will vary greatly. Therefore we find individuals defining health and illness according to their own definitions. We also must realize that culture greatly affects one’s definition of health and illness, therefore as advanced practice nurses in order to provide competent care we must understand health and illness from our client’s perspective.

Topic 2: Cultural Diversity

The United States is a multicultural nation made up of cultures from around the world. According to the US Census Bureau, Asian and mixed-race people are the two fastest-growing populations in the US. Although non-Hispanic whites remain the largest group of Americans at 198 million, they are the only group with a higher death rate than the birth rate. Hispanics follow the non-Hispanic whites at 57.5 million and blacks or African Americans at 46.8 million. With the increase in these diverse populations come issues that tremendously affect their health care. Language barriers and low incomes lead to lower access and availability of health care and therefore less favorable outcomes according to the Institute of Medicine (IOM) report (2003). This results in daily challenges for the nurse to identify the diverse needs of the patients and address them in order to provide quality health care. In order to combat these culturally driven healthcare disparities, the advanced practice nurse must be prepared to meet the unique healthcare needs of all culturally diverse patients in their care.

How to Apply for a Grant

You now have a compelling problem/need statement written, so you’re well on your way to applying for that grant. But the funders are going to need a lot more information than what you put in those few paragraphs.

Now you need to find out more of the specifics that you’ll need to put into the actual grant application. At this stage you will need to complete two things:

  1. Choose one of the funders identified in the first part of the course to do some additional research on and create a list of required items to apply for that grant.
  2. Develop goals and objectives for the program that can be used in the grant application.

Part 1

Research the application requirements for two of the funders identified at the beginning of the course. In a Word document, write 1–2 paragraphs on why you believe each funder has the requirements they do, what, if any, differences there are in application requirements, and what might account for those differences.

Part 2

You will develop clear goals that define what the Resource Center intends to accomplish through the development of the tutorial program, as well as establish measurable objectives that will highlight your organization’s progress toward established goals.

The goals and objectives provide an assessment of the tutorial program’s success to both the organization and the funder. When goals and objectives are not clearly defined, it can not only have an impact on the program’s outcomes, but it can also impact negatively program staff, participants, and funders.

Based on the problem statement you created, you’ll want to answer the following questions:

  • What are the key areas of the nonprofit are you seeking to change?
  • Who (which segment of the population or community) will be affected or involved with the change?
  • How will the change be measured (an increase or improvement, or a decrease and reduction)? And by how much?

DISCUSSION: FAIR AND EQUITABLE?

 

As you have learned from the text and perhaps from your own experiences, characteristics such as gender, culture, socioeconomic status, learning styles, disabilities, and at-risk status can impact the ways that adults relate to and interact with children. As a professional, it is vital that you evaluate your own attitudes and strive to be fair, equitable, and proactive in your interactions with children and families.

Review the “Student Characteristics and Teacher Interaction” section (pages 245-266) of your text.

Then consider the following questions:

  • What are some of the complex issues related to gender?
  • What are some of the complex issues related to culture and diversity?
  • Do all children have an equal opportunity to succeed in school?

Choose two characteristics covered in the section you reviewed that concern you the most in terms of the potential for inequitable treatment of young children.

In this unit, you are introduced to personality tests and issues with their development and use. One particular area of debate involves the inclusion of validity scales in tests of personality. While many concerns may exist, the use of such scales appears to be increasing and they continue to be utilized and interpreted.

In your post:

  • Analyze how validity in psychometrics, as you explored in Unit 4, is different from a validity scale in a test of personality.
  • Describe this difference in terms of their definitions.
    • Provide at least two examples of validity scales.
  • Integrate and cite the AERA standards from Chapter 10, “Psychological Testing and Assessment,” of your Standards for Educational and Psychological Testing text that directly address validity scales. Provide your interpretation of the standards and the use of validity scales.

Case Studies 1 : Urinary Obstruction.

Urinary Obstruction.

The 57-year-old patient noted urinary hesitancy and a decrease in the force of his urinary stream for several months. Both had progressively become worse. His physical examination was essentially negative except for an enlarged prostate, which was bulky and soft. 

 

Studies  / Results.                                 
1- Routine laboratory studies  :  Within normal limits (WNL)

2- Intravenous pyelogram (IVP):   Mild indentation of the interior aspect of the bladder, 

indicating an enlarged prostate 

3- Uroflowmetry with total voided flow of 225 mL : 8 mL/sec (normal: >12 mL/sec) 

4- Cystometry:  Resting bladder pressure: 35 cm H2O (normal: <40 cm H2O) and  Peak bladder pressure: 50 cm H2O (normal: 40-90 cm H2O)

5- Electromyography of the pelvic sphincter muscle:  Normal resting bladder with a positive tonus limb. 

6- Cystoscopy:  Benign prostatic hypertrophy (BPH)

7- Prostatic acid phosphatase :  0.5 units/L (normal: 0.11-0.60 units/L) 

(PAP)
Prostate specific antigen (PSA): 1.0 ng/mL (normal: <4 ng/mL)

Prostate ultrasound :  Diffusely enlarged prostate; no localized tumor 

Diagnostic Analysis 

Because of the patient’s symptoms, bladder outlet obstruction was highly suspected. Physical examination indicated an enlarged prostate. IVP studies corroborated that finding. The reduced urine flow rate indicated an obstruction distal to the urinary bladder. Because the patient was found to have a normal total voided volume, one could not say that the reduced flow rate was the result of an inadequately distended bladder. Rather, the bladder was appropriately distended, yet the flow rate was decreased. This indicated outlet obstruction. The cystogram indicated that the bladder was capable of mounting an effective pressure and was not an atonic bladder compatible with neurologic disease. The tonus limb again indicated the bladder was able to contract. The peak bladder pressure of 50 cm H2O was normal, again indicating appropriate muscular function of the bladder. Based on these studies, the patient was diagnosed with a urinary outlet obstruction. The PAP and PSA indicated benign prostatic hypertrophy (BPH). The ultrasound supported that diagnosis. Cystoscopy documented that finding, and the patient was appropriately treated by transurethral resection of the prostate (TURP). This patient did well postoperatively and had no major problems.
