Who’s In Charge

Note: This discussion posting has two parts, and you are expected to respond to both parts of the discussion question.

In chapter 7, your text explores the ways in which men and women tend to differ in terms of gender role-ideology, perceptual abilities, conformity and obedience, aggressiveness, sexuality, and personality, among others. After reading this section, answer each of the questions below:

  1. If you were given a second life and could choose to be either a man or a woman, which gender would you select? In presenting your answer, list reasons for your choice of returning as a man or a woman.
  2. Think for a moment about the role of a husband and the role of a wife. What should a husband and wife be like? When presenting your answer, consider the following questions (you do not have to answer or include all of these—they are simply to stimulate your thoughts): Who should complete household chores (inside and outside)? Who should make home repairs? Who should spend the most time with the children? Whose responsibility is it to take care of the older parents? Who should earn more money? Who should make family decisions? Who should be a stay-at-home parent? Who should prepare meals or wash the dishes?

Using the corporation you chose from Assignment 1, examine its industry. Research the company on its own Website, the public filings on the Securities and Exchange Commission EDGAR database (http://www.sec.gov/edgar.shtml), in the University’s online databases, and any other sources you can find. The annual report will often provide insights that can help address some of these questions.

Write an eight to ten (8-10) page paper in which you:

  1. Choose the two (2) segments of the general environment that would rank highest in their influence on the corporation you chose. Assess how these segments affect the corporation you chose and the industry in which it operates.
  2. Considering the five (5) forces of competition, choose the two (2) that you estimate are the most significant for the corporation you chose. Evaluate how well the company has addressed these two (2) forces in the recent past.
  3. With the same two (2) forces in mind, predict what the company might do to improve its ability to address these forces in the near future.
  4. Assess the external threats affecting this corporation and the opportunities available to the corporation. Give your opinions on how the corporation should deal with the most serious threat and the greatest opportunity. Justify your answer.
  5. Give your opinion on the corporation’s greatest strengths and most significant weaknesses. Choose the strategy or tactic the corporation should select to take maximum advantage of its strengths, and the strategy or tactic the corporation should select to fix its most significant weakness. Justify your choices.
  6. Determine the company’s resources, capabilities, and core competencies.
  7. Analyze the company’s value chain to determine where they can create value using the resources, capabilities, and core competencies discussed above.
  8. Use at least three (3) quality references. Note: Wikipedia and other Websites do not quality as academic resources.

Your assignment must follow these formatting requirements:

  • Be typed, double-spaced, using Times New Roman font (size 12), with one-inch margins on all sides.

Legal and Ethical Scenarios

Select two of the scenarios provided below. Analyze the facts in the scenarios and develop appropriate arguments and recommendations using case law and scholarly sources. Do not copy the case studies into the paper. Cite your sources in APA format on a separate page. Submit the paper to the Submissions Area by the due date assigned.

Scenario 1—Bankruptcy

Katrina, a risk manager for State Farm Insurance, filed a petition in bankruptcy under Chapter 7, seeking to discharge $55,000 in credit-card debts and $35,000 in student loans.  Katrina’s husband died and left her with two children, Paula, who attended college, and Dean, who was fifteen years old.  According to Katrina, Dean was an “elite” runner who practiced ten to fifteen hours a week and placed first or second at more than forty competitive events. Dean was homeschooled with academic achievements that were average for his grade level.  Katrina’s petition showed monthly income of $5,400 and expenses of $5,100.  The expenses included annual homeschool costs of $6,200 and annual running expenses of $7,500.  The expenses did not include college costs for Paula, or airfare for her upcoming summer trip to Italy, and other items.  The trustee allowed monthly expenses of $4,400, with nothing allocated for running expense  and asked the court to dismiss the petition.

  • If Katrina qualified for Chapter 7, which debts would be discharged?  Which debts would not be discharged?  Why?
  • Using the median income from your state, does Katrina qualify for Chapter 7?  Remember to count the number of people in the household.
  • Should the court grant the trustee’s request?  Does Katrina have other options if the Chapter 7 petition is dismissed?
  • Explain your answers and support them with relevant scholarly sources.

Scenario II – Insurance

Juanita owns a home in Birmingham, Alabama.  Her elderly grandmother lives in the house so Juanita can help take care of her.  Juanita decides to purchase a fire insurance policy from Allstate to cover the house and a life insurance policy from Liberty Mutual to cover funeral and other expenses that will be incurred when her grandmother dies.   Six months later, Juanita sells the house to Ben.  Juanita and her grandmother move into a rental home.  One month prior to the expiration of the fire insurance, Juanita’s old house burns to the ground.  Shortly after, her grandmother dies.  The insurance companies state that they are not liable because Juanita did not have an insurable interest in the home or her grandmother.  The premiums were returned to Juanita.

  • Discuss the claims for all parties (Juanita, Allstate and Liberty).

Scenario III— Bankruptcy

Locate one of the following scholarly articles about bankruptcy in the SUO Online Library.  Summarize the article in your own words.  Identify and discuss the most important aspect of the article, as well as any ethical issues.

Persuasive Campaign for Online Education

Design a persuasive campaign aimed at promoting online education. In explaining your campaign, you must identify the following items:

  • The campaign’s central message or slogan
  • The target audience for the campaign
  • The medium used to promote the campaign
  • The intended persuasion outcome for the campaign

After providing the details of your campaign, you must explain why you believe this campaign will be effective using at least three of the persuasion theories that you learned in this course. You will need to cite at least four (4) outside sources besides the textbook. Material from those sources can be used to support details of your campaign or the persuasion theories that you reference in the paper. The paper must contain an introduction with thesis statement, at least five body paragraphs, and a conclusion. For a review of how to create these elements of an essay, visit the University of Arizona Global Campus Writing Center (Links to an external site.). The explanation of the campaign should be no more than 1000 words out of the total word count.

The Final Paper

Carefully review the Grading Rubric (Links to an external site.) for the criteria that will be used to evaluate your assignment.

ART reflection essay

Final Reflection Essay: What have you brought to the table? What did you take from the table?

DUE: 11:59pm, Monday May 10, 2021

LATE submissions will be accepted until 8am Thursday May 13 but subject to an automatic 10% point reduction.

NO ESSAYS should be submitted BEFORE our final group critique of all the finished bowls on (hopefully) Wednesday April 28, 2021.

Length: minimum 1500 words, double spaced

For the Final Reflection Essay students will draw on their overall experiences in this course.

As you prepare to write your Final Reflection reread your previous reflection assignments and reflect on what you said then and compare that to how you feel now.

Most important for me is how this class builds community, both in and out of the studio.

You may use some of the content from your other reflection essays, especially if it addresses any of the prompts below. However please DO NOT cut and paste word for word large sections of earlier essays. You may use the content or ideas from earlier reflection essays, but it must be with renewed research and/or personal reflection. Use the Final Reflection essay as an opportunity to revisit or revise previous viewpoints.

You may copy word for word the self-critique you submitted for the Final Studio Production assignment submission, as well as include photos of your bowls, garden creations and/or coloring pages if these help illustrate your Final Reflection narrative.

You may find it helpful when organizing your essay to use headings for different sections. However I will still want to see an intro and a conclusion. Examples of headings could be “Service for Siena/Francis”, “Working for social justice in the studio”, etc.

Your essay should include the following:

  • brief statement about your Empty Bowls experience. I want to use these statements in the promotion and display for the next CU Empty Bowls event (2022). You can lead with this statement (like an epigraph before the body of your essay) or include it at the end. Just make sure I know where it is, so I can easily extract it.
  • A reflection on one or more of the CCAS Charisms downloadand describe how they manifest in this course.
  • Clearly articulated self-disclosure and connections between course activities relevant to the learning objectives listed below. For some objectives or group of objectives I’ve recommended possible course activities (studio time, service, readings) you can use to discuss your experiences relevant to the objectives. You do not need to address all of the objectives individually.

Intersections

  • Students will become engaged in a problem (Homelessness and food insecurity in Omaha), explore its complexity through critical reading and research (course readings and previous essays), analyze and evaluate alternative solutions (studio and service activities), and justify a chosen solution with a reasoned argument.
  • Students will describe personal involvement in work related to service and/or advocacy for social justice. (relate how your work in this class contributes to the mission of Siena/Francis and the CU Empty Bowls project)
  • Students will integrate learning from various disciplines and experiences to articulate their vision of justice, of serving the common good, and of working as agents of social justice as community leaders, and global citizens. (How did this class relate to your major? Was there something you learned in another core course that was reinforced in this class?)

Designated Ethics

What are our ethical responsibilities as informed citizens?

What does it mean to “give”? Was it difficult to give “away” your bowls?

  • Students will apply analytical tools, content knowledge, and ethical principles to contextualize social conditions, evaluate the consequences of injustices, and identify opportunities to promote social justice.
  • Students will distinguish the morally relevant features of complex practical situations in the context of a chosen academic discipline, profession, or sphere of ethical responsibility.
  • Students will apply fundamental moral theories and principles, such as consequentialism, deontology, and/or virtue theory in a chosen academic discipline, code of conduct, profession, or sphere of ethical responsibility.
  • Students will critically evaluate the relationship between their ethical presuppositions, their responsibilities to society, and the values of their chosen academic discipline, profession, or sphere of ethical responsibility.

AcSL

Did this class motivate you to continue working toward the greater good? If so, how?

  • Students will integrate learning of disciplinary knowledge, gained through classroom exercises, with experiential knowledge, gained through direct contact with the everyday problems of real people.
  • Students will encounter, serve, and form relationships through structured opportunities with individuals and communities that might otherwise remain outside their personal experience.
  • RECOMMENDED but not required: Photo-documentation of course activitieswhich supports the content of your essay. This may include your bowl making process, finished bowls, “bowls in action”, service for Siena/Francis, etc. This photo-documentation can be imbedded in your essay, listed as an Appendix with references such as “see Appendix figure 1”, or included at the conclusion of your essay. Whichever way you choose to visually represent your experiences in this course make sure it is easily followed and accessible.

Paper’s should be well written with little to no spelling or grammatical errors.

This semester was extremely challenging and this essay is an opportunity to communicate to your professor your ideas on improving this course in the future. A vital component of this essay is personal reflection on the combined efforts of all involved. Therefore all essays should include an assessment of the class as a whole, not just your individual contribution. As such no essays should be submitted prior to our last class of the semester.

Please let me know if you need feedback on drafts or have questions.

Respondo nino 668to

Please respond to the following write ups  Address some of the problems, if any, with the current malpractice legal system related to malpractice with references.

Response 1

Advanced practice nurses (APN) are a part of an increasingly complex health care system and currently twenty-eight states allow full practice authority for APNs (American Association of Nurse Practitioners [AANP], 2021). The APN faces similar professional liability risks as the primary care physicians because they have the responsibility to protect their patients and themselves by practicing within the scope of practice that is mandated by the state statute, rules, and regulations (Heuer et al., 2019).

According to Joel (2018) table 29.1 and 29.3, in Arizona, the APN had a total of 103 medical malpractice payments from 1990-2014, while the physician had a total of 5,194 during the same time. The highest claim number for the APN was 11 in the years 2007 and 2011 and the highest number of claims for the physician was 307 in 2003. Tables 29.2 and 29.4 from Joel (2018) show the APN had a total of 21 adverse actions taken against them in Arizona from 1990-2014, while the physician had 3,337 adverse actions reported during the same time in Arizona. The difference in claims may be related to the number of practicing physicians compared to practicing nurse practitioners and the patient-provider encounters. Brock et al. (2017) discuss that three-quarters of malpractice counts against APN are due to diagnosis or treatment-related events while the physician has half of their malpractice counts for the exact reason. There could be a difference in claims in adverse events because all adverse licensure actions, clinical privilege actions are mandatory for physicians to report while it is voluntarily reported by APNs (Joel, 2018). In addition, medical errors and near misses are often and not report and not all significant allegations will result in an award, so they are not reported to the NPDB (Brock et al., 2017).

Respose 2

Practice safety is the expectation for all providers, and malpractice is a serious issue.  Malpractice is considered practice that is improper, negligent or criminal (Dictionary.com, 2021).  Exposures for malpractice in Advanced Practice Nursing include: financial risks, civil and criminal risks, and licensure risks (Joel, 2018).   Similar risks are assumed by physicians and physician assistants as well.  The unfortunate reality is that mistakes happen and all providers must protect themselves with best practices, and malpractice insurance.

In Joel (2018), the data for malpractice suits were significantly lower for Nurse Practitioners as compared to physicians.  While there may be many reasons for this, one important factor for this may be that up until 2021, APRNs in the state of Massachusetts were not allowed independent practice. It is thought that the rates of malpractice claims against APRNs may rise in conjunction with independent practice (Gardnier et al., 2015).  Sweeney et al., (2017) states that malpractice claims against APRNs are increasing over time.

The majority of claims against nurse practitioners is diagnosis related, and a majority involved independent practice (Sweeney et al., 2017).  Avoiding malpractice claims and suits involves excellence and precision in care along with other strategies and skills such as: good communication, good documentation, knowing your limits as an NP, not allowing others to dictate care, and prompt responses to patients (Brown, 2014).

Nursing is a patient-centered endeavor at its core.  Advanced practice nursing is no different, and quality outcomes are a function of that care.  Malpractice can harm the care by raising the cost of care and thereby potentially reducing patient access to care. The malpractice system may also affect treatment by inducing providers to practice defensive medicine or avoid reporting incidents (Renkema, 2014).  As APRNs broaden their influence and practice, it is imperative to be aware of the pitfalls, and gain strategies for the best, safest delivery of care.
