Discussion 02.2: Intentional Torts

HA4050D – Healthcare Law

Discussion 02.2: Intentional Torts

Read the Discussion 02.2 Scenario. Refer to this scenario as you answer the questions below.

1.What INTENTIONAL tort theories (NOT NEGLIGENCE) might apply here? What facts fit the elements of those tort theories?

2.Consider the extent of the hospital’s monetary liability. If you were on the jury in this case, how would you calculate an amount of damages? Did taking the photographs cause any economic damages (cost the plaintiffs money)? Probably not. Did they cause pain and suffering? How do you think a jury might arrive at a dollar figure to award in a case like this?

  DISCUSSION 02.2: INTENTIONAL TORTS

SCENARIO (BASED ON A REAL MAINE CASE)

You are an administrator in a medium-sized hospital. One of the physicians, Dr. McKee, comes to you

to tell you about something disturbing she has just witnessed.

A hospitalized patient suffering from cancer of the larynx was under the care of another physician, Dr.

Smallwood. The patient’s condition was somewhat unusual and of interest to several of the oncologists

who had examined it. The patient had initially permitted Dr. Smallwood to take several photographs that were to be used for the medical record, but he was adamant that they not to be used for

publication.

Later, a few hours before the patient died, Dr. Smallwood and a nurse took more photographs, moving

the patient’s head for the photos, despite the patient’s clear wishes that he did not want any more

photos to be taken. Dr. Smallwood then uploaded the photos to a discussion group to share them with

fellow surgeons.

Soon after the patient died, his wife discovered that additional photos were taken and was outraged.

Dr. McKee just witnessed the patient’s widow have a heated conversation with Dr. Smallwood and then

storm out, threatening to sue the hospital.

You immediately begin drafting an email to inform your supervisor about the situation. You want to

include the following in your memo:

music and politics

  1. How does the Obama campaign’s use of music support the assertion that he is “the first U.S. president who is also a superbrand?” (115)
  2. What are some of Obama’s criticisms of hip-hop culture? What elements of hip-hop culture does Obama praise?
  3. What are some elements of hip-hop culture that Obama incorporated into his 2008 campaign?
  4. Consider the lists of Obama’s Musical Taste (Table 1, 127, and Figure 3, 128). Do the selections marked for rally playlists (X) have any shared qualities? Why do you think the other musicians were not included in the rally playlists?
  5. Gorzelany-Mostak discusses at length Obama’s use of Stevie Wonder’s “Signed, Sealed, Delivered” as entrance music (129-132+). How did this song resonate with audiences? In particular, with Obama’s female constituents?
  6. How did Obama use music to balance between the poles of “social feminization and… stereotyped hypermasculinization” described in the Gorzelany-Mostak’s conclusion?
  7. Provide a brief summary of the different functions music served for the Obama campaign in 2008. (In other words, how did the campaign use music to affect Obama’s image?)
  8. Could Obama’s Republican opponent, Senator John McCain, have found similar success with the same music selections? Why or why not? What musical selections would you have chosen for the McCain campaign?
  9. What would be the theme song of your campaign if you were running for President? Why?

Predictive Analytics and Business Forecasting- Time series regression

You will have to select a business problem that interests you (the instructor will suggest a problem in case you run out of ideas.)  Problem data/facts should be real, obtained from verified sources, and correspond to realistic situations.  Your team will prepare a PowerPoint presentation, to be presented in class. Your team may also submit a written section that includes your SAS code or any coding for other analytical methodology used in this project. The presentation should be no more than 30 slides.

It will utilize time-series analysis to construct a forecast model using SAS. You are expected to collect real-world data, and have it approved before you begin your analysis. The purpose is ultimately to make a predictive model that accurately forecasts a given variable from other values.

Sell – Tell –Compel Method

You should use the following structure to present the findings from your projects. This is the most common method for business/analytics presentations. It will help you organize your project in an easily presentable manner.

Sell your audience on the importance of your research.

The first section is an introduction to the problem that you will be solving. Provide background and context for your presentation. This is also where you will establish the theory for the correlation of variables in your model. Include in this section approx. 5 academic and/or journalistic publications that outline both the need for this predictive ability and why you decided to use the method that you did. (E.g. This article says that heart disease is preventable yet kills thousands every year; these articles say that these factors influence heart disease; therefore, controlling these factors that correlate with heart disease will help prevent it)

Tell the story of your scientific process/research.

The next section includes the steps that you took to reach your conclusion. Start by describing your data, then identify the variables that you used. Then state the hypothesis (H0 and HA). Explain the model that you are using and how you came to this. Show not only your final model, but each model that you tried and why you included, transformed or excluded variables (multicollinearity, norms violated, high p-values, etc.). Please validate your model with residual analysis and/or collinearity (VIF) table. Finally, show the model statistics in table form and any graphs of your model. This section is the heart of your presentation and should represent the majority of your slides.

Compel your audience to action

The final section is the presentation of your conclusion and implications for the future. If your null hypothesis is rejected, explain what impact this has on the subject of your research. If the null hypothesis is not rejected, then suggest variables to add or remove from your model or how would you modify your theory in future research.

PEER REPLIES (2)

  • In 100-150 words, respond to two peers’ main posts.  Offer your thoughts on the effectiveness of your peer’s revised paragraph. Make a suggestion for possible further revision.  Also comment on your peer’s approach to the revision process. Identify any considerations or strategies that your peer may not have identified initially.

Yarianne Direntau Avila,

Anne Lamott, in her essay, “Shitty First Drafts” says, “The first draft is the child’s draft, where you let it all pour out and then let it romp all over the place, knowing that no one is going to see it and that you can shape it later” (Lamott 1). This is exactly how I feel. I had a teacher once who told me just to let whatever is in my brain spill out onto the paper. That way, whatever is in my brain thinking about the words that I will use to express my thoughts can work on what I put on paper. I try to remember that because what spills out in my rough drafts is so bad that I usually have a hard time seeing how to make it better.

Original Paragraph

Similarly, parents with inadequate knowledge are likely to frustrate the treatment process. It is worth noting that the treatment process is bound to be involving. Parents are to be alert on every move. This area is very significant in managing developmental issues. Providing adequate education to parents fosters their effectiveness in the treatment process. They will be more vigilant during recovery.

Revised Paragraph

Similarly, parents with inadequate knowledge are likely to frustrate the treatment process. It is helpful to educate parents on what the treatment process involves. Parents should be informed on each aspect of it and be able to ask questions when necessary. This type of parental control is significantly useful when it comes to children with developmental delays or disorders. Parents who understand what is happening can be more involved and more helpful to healthcare providers. They will also be more vigilant when their child is recovering, and this can speed recovery.

I do though manage to make my rough drafts better by leaving them alone for a day or so and returning to them. By then, my brain has done the work that needs to be done, and I see another way to express what I have said that I like better. Richard Bullock, Michael Brody and Francine Weinberg, authors of The Little Seagull Handbook say that giving oneself time to revise is important (Bullock, Brody and Weinberg, The Little Seagull Handbookd 13). Bullock and Maureen Daly Goggin, author of The Norton Field Guide to Writing agree. Revision should take place after sufficient time has been allowed since the rough draft was created (Bullock and Goggin, The Norton Field Guide to Writing 351).

3-1 Project: Organizational Sales

 Overview:

Uncovering organizational inefficiencies is the first step to optimizing performance. In order to determine what inefficiencies exist, you need to perform a data analysis. A good place to start is with sales. You have to know what data to analyze as well as how to use specific tools for data analysis. Using the IF function, pivot tables, pie charts, bar charts, and histograms can help you isolate and organize specific data in a way that makes it easier to read. Studying measures of central tendency can also help reveal important information. After you discover where inefficiencies in sales exist, you need to be able to articulate the impact this has on the organization.

 Prompt:

For this assignment, you will use the Vinho Winery Case Study and other course resources to review raw data sets that summarize the production, sales, and distribution of wine. You will need to analyze the various types of wine and different distribution centers to determine their financial impacts on the organization’s total revenue. All of your analyses need to be submitted in an annotated Excel file, and each analysis needs to include a rationale.

Specifically, the following critical elements must be addressed:

A. Using a pivot table, determine the percentage of wine varieties sold from each distribution center. Illustrate your results in the form of a pie chart. Hint: Create a pivot table using the data spreadsheet as its basis.

B. Generate a labeled bar chart that illustrates the sum of wine varieties sold to each distribution center.

C. Using a pivot table, calculate the total amount of revenue generated for each distribution center. Illustrate your results on a bar chart. Hints: Production cost data is provided in the Costs and Distances tab. Make sure you don’t mix your units of measurement (i.e., pallets, cases, or bottles).

D. Using the IF function, calculate the central tendencies (mean, median, and mode) of shipment volume for each distribution center. Illustrate your results in a table. (Do NOT use a pivot table or manually identify each cell to be evaluated.)

E. Analyze the frequency of shipment by size using a histogram. Use the following bin sizes (number of pallets): 72, 48, 24, 18, 12, 6, 3, 1.

F. Create a shipment histogram to show the distribution of shipments for Portland and Riverside. Use the same bin sizes as you did in Part E. Hint: Use the alphabetical sort for the destination column, and select Data Analysis to plot the frequency of pallet shipments using the bin sizes listed for the two destinations separately.

G. Provide a summary statement that describes the inefficiencies in the organizational sales analysis. In your response, explain why this information is important for influencing management decisions. Rubric

Guidelines for Submission: Your assignment must be submitted using the Case Study Data Set Microsoft Excel document. Use 11-point Calibri font. Critical Elements Exemplary Proficient N

Applied Final Project Part 3: Parenting Action Plan

PART 3: PARENTING ACTION PLAN

You’ve crafted your case study. You’ve done your research on the topic. Now it’s time to identify some solutions in the form of a Parenting Action Plan.

Your Parenting Action Plan should be about 2000-3000 word in length and follow APA style (7th edition). Be sure to use in-text citations and include a reference list.

Copy and paste your case study at the beginning of your document to provide the context for your research essay. (This will not count towards your word total.)

Your essay should be written in your own words and you should always cite any ideas that come from another source. Do not use quotations or copy verbatim from another author.

Your action plan can build on your existing research essay, but the action plan itself will include a few additional components (denoted with an * below). The research you have done should be carefully woven into your action plan. In other words, don’t just copy and paste your research essay and tack on more words. Use the research to justify the actions you are proposing.

  • Statement of the problem: A statement of the key issues that must be explored in order to resolve your case study.(This can be the same as the statement in your research essay)
  • Incorporation of at least 10 credible sources from within the past 10 years that can be used to support a parenting action plan. At least 5 of these sources must be scholarly social science research articles, and at least 3 of the sources must have been published within the last 2 years.
  • *Incorporation of parenting or developmental theories to provide a framework for the proposed action plan.
  • *Description of potential sites of impact (Step 6 of the Planning Table).
  • *Identify an action plan grounded in research that may address concerns posed by the case study (Step 7 of the Planning Table).
  • Correct use of in-text citations and corresponding reference list (APA 7th edition).
  • Use of APA 7th edition format (1” margins, standard font, double spacing, page numbers, etc.).
  • Demonstration of strong writing skills.

Submit your essay to the assignments folder and run the paper through Turnitin.com (You can do this from within the assignments folder. No need to use a separate account). If you submit your work before the deadline, you can use the Turnitin report to evaluate whether your paper requires additional editing.

Your Parenting Action Plan will be evaluated according to the following rubric:

Describe how Starbucks’ human resource management practices enabled them to build their culture and become a successful company

.2.Starbucks’ strategy often enabled the company to successfully compete in a heavily saturated market of coffee shops and eateries. Describe Starbucks’ strategy. What are some key elements of their strategy that enabled them to maintain a competitive advantage and keep customers?

3.As Starbucks’ business expands, it continually faces issues on how to keep customer satisfaction high and maintain and attract business. How has innovation and change specifically contributed to the success of the company? As the company grows larger, what types of changes are being made to the structure, technology, and people in the organization?

                                             FINANCE ASSIGNMENT

Please: answer the questions below. Use either the Bloomberg terminals located at the Feliciano School of Business or other reputable sources such as finance.yahoo.com, morningstar.com or Wall Street Journal etc. for the financial data you use in your answers. You need to provide the references regarding the financial data you use to support your answers at the end of the finance portion of the term paper.

Questions:1.Expanding the number of stores in a foreign market, such as the expansion plan launched by Starbucks in China (announced in 2018), is a major capital budgeting project. A project of this scale requires coordinated planning across all functions of a business that youare studying in your Integrated Core classes. Choose and discuss three items on the income statement that you think will be impacted by this new undertaking. Explain why you chose those particular items, and how those items are impacted by the marketing, management and operations decisions of the company.

2.Choose and calculate threeratios for Starbucksfor the last two years. Make sure to select ratios that you think would be impacted by expanding in a new market, and explain your reasoning. Identify acompetitor of SBUXand contrast the ratios. Explain why you selected thiscompetitor. Describe how thedecisions made by management, marketing and operations functions of the company can impact, and hopefully improve, these financial ratios.

3.Explain how the financial decisions regarding opening a new store are related to management, marketing or operations decisions that the company must make (or has made)?

Higher Education Project Prt 2

This week’s assignment is the second part of a three-part Course Project which requires you to develop a financial plan for a department within an institution of higher education. Continue using the “Develop a Financial Plan” Word template which you downloaded and saved in Week 4 to complete the Course Project. The Course Project is based on the following scenario:

A new president has been selected to run your university. His first initiative is to impose a new strategic direction that focuses on three key priorities:

· Increasing student engagement

· Integrating information technology into programs and services

· Developing measurable learning outcomes

This has the potential to change a number of operations, priorities, and the allocation of resources in your department.

For Part 2 you will consider how your department should reallocate resources to meet the new initiatives you have identified, how these initiatives should be funded, and how a change in operations should be assessed given the new priorities.
