You are the manager of Acme Fireworks, a fireworks retailer who sells fireworks, puts on ground display fireworks, and large aerial display fireworks. The company started in the owner’s garage two years ago and now has 15 employees that you manage. The company started as a sole proprietorship, and the owner has never changed the entity. The owner has informed you that the company has received inquiries from several large businesses wondering if the company could create several fireworks displays on a regular basis. The owner told the inquirers that the company could fill such display orders, and a price per display was agreed upon. It was discussed that most of the cost for a fireworks display is for skilled labor, insurance, and the actual service of setting off the fireworks. No other details were discussed. The owner is anticipating that new employees will need to be hired, but he is worried that if the large orders for fireworks displays do not continue, the company will not have the funds to pay the new employees. The owner is now considering changing the business entity, but he does not know what entity to form or how to form it.

The owner has asked you to do the following:

  • Determine if the contracts with the businesses will be governed by common law or the Uniform Commercial Code (UCC), and explain why.
  • Analyze whether the owner formed a contract with the businesses, and apply the five essential elements of an enforceable contract.
  • Explain the potential personal liability to Acme Fireworks if a spectator is injured by a stray firework from a fireworks display.
  • Discuss the different employment types and relationships relevant to agency law, and analyze the advantages and disadvantages of each type specific to Acme Fireworks.
  • Explain why Acme Fireworks should not operate as a sole proprietorship. Recommend a new business entity, and provide rationale to support your recommendation.

STEP 2: Once you have finished reading these editorials, you will need to write a multi-mode paper (: meaning your paper will both summarize and analyze).  Your paper should begin with an introduction and a thesis unifying the two objectives in step 3 and step 4. Should you need help with thesis statements, introductions and transitions, please reference the English learning module in our course OR the Writing Center. NOTE: Remember this is a humanities paper. There are MAJOR differences in the style of writing between APA and MLA. Review these differences before beginning your draft.  

 

STEP 3: After the introduction, construct several body paragraphs where you will summarize each debater’s opinion. You will need to SUMMARIZE the debater’s stance (pro-con) in light of the question upon which the debate is centered. In order to complete this step successfully, you will need to refer to the “How to write a summary” handout found in the English help learning module to write your summary in the necessary manner. Take note on the guideline regarding length—a summary for this piece should be in the one to two short paragraph range. Also note that summaries do not include personal opinions or additional information not found in the piece being summarized.  

 

STEP 4: Then, read the editorials again carefully, centering on the reasons why the author is either pro or con. You’ll see that the authors give different reasons in the editorials. Using the HCTSR (Holistic Critical Thinking Scoring Rubric in your text), analyze and evaluate the critical thinking evident in these editorials. ASSIGN EACH DEBATER A NUMBER and justify it. What critical thinking skills are apparent in their essays? Give me at least TWO examples per debater. Be sure to write about your reasons justifying in specific detail why you gave the editorial the score that you did. Point out words, thoughts, etc. that led you to your evaluation. STEP 5: Bring your paper to a conclusion. In your conclusion, give your personal opinion of the issue, but your opinion should not be in steps 3 or 4. The conclusion is the only place your opinion should appear. Otherwise, in the body of the paper, you are only evaluating debates using the HCTSR criteria.

Aggressive and disruptive behaviors are often seen on inpatient psychiatric units where patients are in their most acute state, and the direct-care staff and nurses responsible for managing such problem behaviors are placed in high-risk situations for adverse events such as physical or psychological assault and trauma. Workplace injuries resulting from such instances are a substantial burden on the unit, administration, and staff member themselves, and consequently, much energy has been expended to formulate approaches to prevent such injuries (Romani et al., 2020). Studies have shown the implementation of staff training initiatives focused on decreased utilization of restraint and seclusion, incorporation of alternative crisis de-escalation strategies, and fostering coping skill development have lowered the incidence of such problem behaviors reducing the risk to both patients and staff (Eblin, 2019; Kantaris et al., 2020; Romani et al., 2020). 

There are multiple programs available to facilities and organizations which incorporate such strategies, and the decision to select a program or switch programs can be a monumental undertaking affecting every level of an organization and requiring significant considerations from all stakeholders involved (Spears & McNeely, 2019). One such program is offered from the Mandt System (2020), and a literature search of the programs resulted in a single research study which found an overall positive effect on the aggression and violence from implementation of the Mandt System, but the results could not be validated due to a scarcity of corresponding research (McDade, 2017). McDade (2017) did not find a decrease in the rate of patient to staff incidents at East Mississippi State Hospital after the implementation of the Mandt System. 

A descriptive correlational research design can be utilized to answer the following research question: why did the frequency of patient to staff incidents remain the same after the introduction of the Mandt system? This designed appears to offer the flexibility to examine all possible variables in explaining a rather complex research question by examining the relationships between and among all variable combinations to illuminate any possible correlations capable of offering an explanation to the research question (Gray & Grove, 2021). This explanation could then allow further research by allowing future researchers to test the effect of the removal of some variables.

Environmental deprivation, deafness, and neurological disruption such as stroke or brain injury will absolutely influence language acquisition, production, and/or comprehension.

            As Kuhl (2010) notes, an infant’s brain is extremely malleable and is constantly changing as it absorbs information from its surroundings. The brain uses auditory and visual cues to gather knowledge about language, so any deprivation of this during the time of language acquisition is going to hinder learning language, and in turn, producing it (Kuhl, 2010).

            Stroke or injury to the brain in later life can also affect language. As the neuroscience of language becomes better understood, it has been learned that damage to areas of the brain that are known to focus on speech, such as Broca or Wernicke’s area, does not necessarily reflect in symptoms of speech impairment (Poeppel & Hickok, 2004). Further brain mapping using fMRI, PET, EEG, and MEG will allow researchers more insight into brain language research, such as distinguishing areas of function (Poeppel & Hickok, 2004).

            An example that comes to mind comes from a book I read some time ago called The Boy Who Was Raised as a Dog by Dr. Bruce Perry and Maia Szalavitz. In this book Dr. Perry references a child who was, in fact, raised as a dog (Perry & Szalavitz, 2008). The boy lost his caregiver at 11 months old and was raised by an older man who was a dog breeder (Perry & Szalavitz, 2008). With little understanding of how to raise a child, he raised him the way he raised his dogs, even keeping him in a dog cage (Perry & Szalavitz, 2008). He fed and changed the boy but did not interact with him outside of that (Perry & Szalavitz, 2008). The boy lived in that cage for five years, without human environmental stimulation (Perry & Szalavitz, 2008). When he did attend medical appointments, it was found that he had atrophy of the cerebral cortex, and his brain resembled that of a patient with Alzheimer’s disease (Perry & Szalavitz, 2008). By age five, he had little to no language capabilities, among other deficits (Perry & Szalavitz, 2008).

            The lack of human connection, severe environmental deprivation resulted in neurological disruption in this case. These combined issues meant that the boy had no chance to learn, use or comprehend language at any time during the first five years of his life. However, once he was removed from that situation, brought to a hospital and the care of Dr. Perry, as well as speech and language therapists (among others), he began to speak (Perry & Szalavitz, 2008). This example shows just how imperative all aspects of learning can be to be able to develop language, as well as how malleable the brain can be in the face of severe deprivation or neurological damage or disruption.

  2. Perform a risk assessment on three hazards you identified for each activity (six total) using the 4X5 matrix shown in Figure 34-1 on page 492 of the textbook.
  3. Prioritize the need for controls for the hazards you selected based on the results of the risk assessment.
  4. Using the hierarchy of engineering controls listed in Figure 3-3 on page 29 of the textbook, recommend a control
    method for each hazard that you believe would be the most effective in reducing risk to an acceptable level. Explain
    why you made the choice, and support your decisions with at least one reference other than the textbook.
  5. Use the 4X5 matrix to show the reduction in risk for each hazard after the control method has been applied.
  6. For any fall protection that you recommend, be specific about the type of fall protection.
  7. Discuss how prevention through design (PtD) could be used to reduce the risks associated with these operations.

Prepare your project in a properly formatted APA style document including a title page, a brief abstract section, the body of the paper, and a reference page. The body of your paper must be a minimum of four pages, double-spaced (the title page, abstract, and reference page do not count toward the four-page minimum). You must use your textbook and at least one other source outside of the textbook as references.
